products...whether in the framework of Article 10...or under 
other procedures (Articles 8(3), 10(a) or 10(b)).”

Article 14.11 Regulation 726/2004
“Without prejudice to the law on the protection of industrial and 
ccoommmmeerrcciiaall pprrooppeerrttyy, mmeeddiicciinnaall pprroodduuccttss ffoorr hhuummaann uussee wwhhiicchh 
have been authorised in accordance with the provisions of this 
Regulation shall benefit from an eight‐year period of data 
protection and a ten‐year period of marketing protection, in 
which connection the latter period shall be extended to a 
maximum of 11 years if, during the first eight years of those ten 
yyeeaarrss, tthhee mmaarrkkeettiinngg aauutthhoorriissaattiioonn hhoollddeerr oobbttaaiinnss aann 
authorisation for one or more new therapeutic indications 
which, during the scientific evaluation prior to their 
authorisation, are held to bring a significant clinical benefit in 
comparison with existing therapies.”

Novartis Europharm v Commission: Case T‐472/12 and 
Case T‐67/13 (pending)

to annul Commission decisions of 2012 granting MA to Teva 
for “Zoledronic acid Teva” and to Hospira for “Zoledronic acid 
Hospira”.
 Novartis argue that their product Aclasta is entitled to RDP 
as it was granted a separate MA through the centralised 
procedure and, therefore, falls outside the GMA for their 
product Zometa, based on the same active.

Data protection and new fixed combinations of known 
actives
 pproduct based on “different qqualitative compposition of 
active principle(s)” is outside GMA concept and treated by 
Commission as “new and unique” product.
 Article 10(b) of Directive contemplates new data being 
required for new combination as if it were NAS, but not for 
the individual active substances.
 NTA 2005 and NTA 2013 –“… a new ‘combination’ 
medicinal product will have an independent period of data 
exclusivity and market protection from its first 
authorisation within the EU”.

Data exclusivity and fixed combinations – Teva v. EMA: 
Case T‐547/12 (pending)
 ViiV Healthcare UK Ltd obtained centralised MA for the first combination 
of two active substances ((Kivexa)) for use in HIV in December 2004.
 both actives had been approved in single component products and data 
protection had expired.
 both actives plus a different active had been approved in a first triple 
combination.
 one active had been approved in combination with a different active in a 
first two active combination.
 EMA refused to validate Teva’s application for a copy of Kivexa in 
November 2012 because10 year protection had not expired.
 OJ describes Teva’s case as being that Kivexa should be treated as an 
extension falling within the same GMA as the earlier MAs for its 
component parts.
 ViiV, EFPIA, and Eucope have intervened.

The meaning of New Active Substance
 no definition of NAS in Directive or Regulation.

– chemical/biological substance “not previously authorised as a 
medicinal product in the EU”
– “an isomer, mixture of isomers, a complex or derivative or salt 
of a chemical substance previously authorised … but differing 
in properties with regard to safety and efficacy …”
– “aa bbiioollooggiiccaall ssuubbssttaannccee pprreevviioouussllyy aauutthhoorriisseedd bbuutt ddiiffffeerriinngg iinn 
molecular structure, nature of the source material or 
manufacturing process...”
 has appeared ever since in NTA (Chapter 1); appears in June 
2013 version at Annex I, but now reads “differing 
significantly” in indent 2.

Changes in an active substance – Article 10.2(b) of Directive
 principle of Indent 2 also relevant to whether “generic” can be treated 
as qualifying for abridged procedure.
 prodduct must hhave same qualliitatiive composiitiion off actiive priinciiplles to 
meet definition of being “generic” of RMP.
 presumption of Article 10.2(b): “The different salts, esters, ethers, 
isomers, mixtures of isomers, complexes or derivatives of an active 
substance shall be considered to be the same active substance, unless 
they differ significantly in properties with regard to safety and/or 
efficacy.”
 what is important –change in properties requiring further testing, or 
significant difference in safety/efficacy when results of further testing 
are analysed?
 Annex 1 of Directive at Part II(3) states that substance showing any 
change in Pk or Pd or in tox of the active moiety which could changes/e 
profile is treated as NAS.

Ch. 1 of Notice to Applicants (2013) – Annex II
 an application under Article 10 for different salt/ester 
complex/derivative (with same therapeutic moiety) requires 
additional data:
“Evidence that there is no change in the pharmacokinetics of 
the moiety, pharmacodynamics and/or in toxicity which could 
significantly changethe safety/efficacy profile (otherwise, to 
be considered as a new active substance).”
 paras 2.3 and  5.3.2.1: decision on whether different form of 
active substance is NAS should be taken by competent 
authorities on case‐by‐case basis.

Judging NAS status – when and how?
 at the time of the originator’s application or when generic 
company applies years later?
 in the context of national authorisations, see the Lundbeck/ 
escitalopram cases.
 resulted in Commission statement of March 2009 that NAS status 
of product approved centrally must, in future, be defined in the 
CHMP Opinion.
 national authorities have adopted the same approach for 
ddecenttralliisedd.
 June 2013 NTA (Chapter 1) where a product is based on 
modification of existing substance, whether it is NAS should be 
clarified in the AR, otherwise “it will be considered that the 
product at stake contains the same active substance and belongs 
to the global marketing authorisation”. (para 2.3)

Guidance on criteria for NAS
 NAS and single isomers –CHMP Draft Guidance of November 
2010 (consultation ended Feb. 2011).
 14 July 2011 Interim Note from the EMA concerning 
establishment of NAS status. Simplified guidance, but 
extended to all chemical products and standard question on 
NAS added to application form.
– consider structural relationship of proposed active substance with 
authorised substance regardless of indications.
– if structurallyy related must show “some sort of clinicallyy –relevant 
difference”; if not so related, can classify as NAS without showing 
difference is clinically‐relevant.
– derivatives include metabolite and pro‐drug (i.e., in vivo new 
substance is converted to original active).
– manufacturing process relevant if new substance is processed from 
original active substance.

CHMP “Reflection paper” of October 2012 on NAS and 
isomers, salts, derivatives etc of reference active substance
 paper understood to be authored by MHRA/MEB; major 
objections raised on consultation by industry.
 A.R. will describe status for effective operation of 
DCP/MR/Centralised procedures and so industry has clear 
understanding when deciding development programmes.
