mustbeputupforauctionintheorderinwhichtheyappearintheCatalogue.
(c) Exhibitorsaloneareresponsibleforthecorrectnessoftheagesandotherparticularsintheentriesandofthe
particularsofanimalsinthisCatalogue.
(d) Abullisnoteligibleforentryunlessithastwofullydevelopedtesticlesinthescrotum.
(e) AllanimalswillbesoldinEuroand5%commissionchargedtothepurchaser.
(f) AnexhibitormayplaceareserveonhisanimalandgivenoticetotheAuctioneer.Reservepricemustbegivenin

(g) Theexhibitororhisagentmay,whentheanimalisinthering,authorisetheAuctioneertosellatanyprice
(h) Thehighestapprovedbiddershallbethepurchaser,andifanydisputesariseastoanybidtheanimalindispute
shallbeputupagainatthelastundisputedbidandresold,ortheAuctioneermaydeclarethepurchaser.
(i) Thebiddingshallbein“Euro”.Theminimumopeningbidforallpedigreestockshallbe€1500.
(j) Purchasers,onbeingdeclared,togivetheirnamesandaddressesand,ifrequired,pay25%depositinpartpayment,
orthewholeofthepurchasemoneyimmediatelyonthefallofthehammer.
(k) EachanimalmustbeaccompaniedbyanAnimalPassport,whichmustbesurrenderedwhenanimalispresented
foradmissiontoShow.
(I) Alllotswillbecometheabsolutepropertyofthepurchaserfromthefallofthehammer,andmustbepaidforin
fullimmediatelyaftertheSaleandremovedwithallfaultsanderrorsofdescriptionatthecloseoftheShow,but
thisdoesnotrelievetheexhibitorsoftheirresponsibilitiesunderauctionsale.Animalspurchasedforexportmust
beretainedbytheexhibitoruntilshippingarrangementsaremadeandtestedifnecessary.
(m)BuyersdesirousofhavingstockdeliveredcanhavethisdonebyarrangementwiththeAuctioneeratthebuyer’s
absoluteriskandexpense.NeitherthevendornortheSocietywilltakeanyresponsibility.
(n) TheAuctioneeractsasagentforVendors,andanyactiontakenbyapurchasermustbeagainsttheVendorand
notagainsttheAuctioneerorSociety,andviceversaThepedigreeofeachanimalisgivenbytheexhibitor,but
everyanimalwillbesoldsubjecttoallfaultsanderrorsofdescription.
(o) Purchasersnotcomplyingwiththeseconditionswillbeliabletohavetheirlotsre-soldbypublicauctionorby
privatetreaty,attheoptionoftheSociety,thedepositforfeited,andanydeficiencyarisingonsuchre-saletobe
madegoodbythedefaulteratthissalepresentasandforliquidateddamages,butthedefaultershallnotgetthe
benefitofanyincreaseinpriceshouldsuchresultfromre-sale.
(p) AllanimalsenteredintheCatalogueMUSTpassthroughtheSaleRing,andMUSTbeofferedforsalebypublic
auction.AnyanimalnotsoldintheSaleRingcannotre-enteruntilalltheanimalsofhisbreedhavepassedthrough.
(q) AnanimalcanbesoldonlyintheClassinwhichheisentered.If,foranyreason,theanimalshouldhavetobe
offeredforresaleitmusttakeplaceinthesamering.
(r) Ifananimalisunsoldintheringandsubsequentlysoldinthesaleyard,suchsubsequentsalemustbemadeby
orthroughtheAuctioneerappointedbytheSociety.Exhibitorsinfringingthisrulewillberefusedentriestoany
futureShoworSaleundertheSociety.
(s) Exhibitorsaloneareresponsibleforthefeeding,wateringandsafekeepingoftheiranimalsuntilthecloseofthe
Show,whichisafterthelastanimalissold.Everyexhibitormustleaveeachofhissoldanimalswithastronghalter,
suitablefortransit.Failingtodoso,theSocietyisempoweredtoinflictapenaltyof15Euro.
(t) AnyanimalhavingpassedthroughtheSaleRingmayleavetheShowyardunderaDeliveryOrdertobeobtained
fromtheAuctioneer.
(u) Exhibitorsaloneareresponsibleforanydamage,lossorinjurycausedbyunmanageableanimals.TheSociety
acceptsnoresponsibility.
(v) TheSocietyacceptsnoresponsibilitywhatsoeverforanimalsleftovernightinstallsinparkpriortoorsubsequent
toSales.Buyersareresponsibleforanimalssoldandsellersforunsoldanimalsandanydamagecaused.
(w) TheSocietyreservestherightofrefusinganyentrywithoutgivingtheirreasonsfordoingso.TheSocietyalso
reservestherightofmakinganychangesthatmaybenecesssaryinconnectionwiththestatementsofmilkyields
andbutterfatparticulars.
(x) Objectionsand/orcomplaintsmustbemadeinwritingwiththeSecretaryoftheSocietynotlaterthan6o’clock
pmondayofSale,andmustbeaccompaniedbyadepositof10Euro,whichwillbeforfeitedifobjectionand/or
complaintisnotupheld.
(y) ExhibitorsshallappointtheSociety’sAuctioneers(MessrsM.H.McGowan&Co)astheiragentsforthesaleofall
animalsenteredinCatalogue.
(z) Inallcasesofdispute,thedecisionoftheSocietymustbefinal.

CONDITIONSOFSALETOAPPLYON
ALLSALESOFIRISHANGUSCATTLESOCIETY
1. TheseConditions(and,whereappropriateatauctions,theseConditions,togetherwiththeGeneralAuction
ConditionsofSale),formthebasisofthecontractbetweentheVendorandthePurchaser,andfromthe
Contract,allconditionsandwarrantiesimpliedundertheSaleofGoodsAct1893andtheSaleofGoodsand
SupplyofServicesAct1980,oranyotherstatutoryenactmentorimpliedbyanylaworcustomorusageare
expresslyexcluded.
2. IntheeventofaSalebyAuctionandtherearisingaconflictbetweentheseConditionsandtheGeneral
ConditionsoftheAuction,theseConditionsshallprevail.
3. Allanimalsaresoldastheystandandthepurchaserisdeemedtohaveexaminedeachanimalandfully
satisfiedhimselfabouttheanimalpriortosale.
4. Saveashereinafterprovided,nowarrantywhateverisgivenastotheperformanceoffertilityofanybull,and
thePurchaserisherebyinvitedtoinsureagainstthisoranyotherrisksconnectedwiththebull,athisown
expense.
5. TheVendorshallanddoesherebyprovidethefollowingguaranteeastofertilitywitheachbullsold:
(a)Noguaranteewhateverastofertilityisgivenwithanybullundertheageofninemonthsatthedateofsale,
unlessotherwisestatedinwriting.
(b)SubjecttotheConditionshereinaftersetout,theVendorguaranteesthatthebulliscapableofputtinga
coworheiferinastateofpregnancybynaturalservicewithinfourmonthsofthedateofsaleorwithinfour
monthsofattainingtheageoffourteenmonths,whicheveristhelater.Thisguaranteeshallbedeemedtobe
fulfilledwheneveronefemaleanimalisproventobeincalfbynaturalservicetothatbull,subsequenttothe
sale.Abullshallnotbedeemedtobeincapableofputtingacoworheiferinastateofpregnancybynatural
serviceonasementestonly.
6. Theforegoingguaranteeissubjecttothefollowingconditions:
(a)Thebullshallbefairlytriedwithaviewtohimputtingacoworheiferinastateofpregnancybynatural
servicewithintwomonthsofthedateofsaleorwithintwomonthsofattainingtheageoffourteenmonths,
whicheveristhelater.Forthepurposeofthisparagraph,“fairlytried”shallnotbedeemedtohaveoccurred
whenlessthanthreefemaleanimalsinseasonhavebeenproperlypresentedtoorrunwiththebull.
(b)If,uponpurchaseofthebull,itisfoundimpracticalfortheBuyertofairlytrythebullwithintheperiod
statedatparagraph6(a)above,duetothePurchaser’snormalcalvingprogramme,theVendormustbe
informedinwritingimmediatelyaftertheSaleofthemonthinwhichitisproposedtocommenceusingthe
bull.AtthediscretionoftheVendor,thedateofcommencementofthetrialperiodmaybeextendedtothe
firstdayofthemonthinwhichtheBuyerhasnotifiedthemasaforesaidthatheproposestocommenceusing
thebull.TheVendorshallnotunreasonablyrefusetoextendthetimeandinanyeventshallcommunicatehis
decisioninwritingtothePurchaserwithinsevendaysofreceiptofthesaidnoticeinwritingfromthePurchaser.
(c)ThePurchasershallgivenoticeinwritingbyregisteredlettertotheVendorofaninabilityofthebulltoput
acoworheiferinastateofpregnancybynaturalserviceorasuspectedinabilityinthisrespect,notbeforethe
expirationofonemonthnoraftertheexpirationofthreemonthsfromthedateofsaleofthebullattaining
fourteenmonths,oranyextensionforthecommencementofthetrialperiodgrantedpursuanttoParagraph
6(b)above,whicheveristhelater.
(d)OnreceiptofthenoticereferredtoatParagraph6(c)above,theVendorshallforwardtothePurchaseraBull
FertilityReport,whichshallbecompletedbyaqualifiedVeterinarySurgeonandreturnedtotheVendorwithin
thirtydaysofthedateofissue,accompaniedbyaCertificatebyaqualifiedVeterinarySurgeondeclaringthat
theinabilitytoputacoworheiferinastateofpregnancybynaturalserviceisnottheresultofinjury,accident,
diseaseorneglecthappeningaftertheSale,andthathehasexaminedthecowsorheifersonwhichthebull
hasbeentried,andhasfoundtheminanormalbreedingconditionandthattheyarenotresponsibleforthe
bull’sinabilitytoputacoworheiferinastateofpregnancybynaturalservice.
(e)ThePurchasershallgivethebulleveryopportunityofprovinghimselfcapableofputtingacoworheifer
inastateofpregnancybynaturalservicewithintheperiodoffourmonthsmentionedintheguaranteeat
Paragraph(5)aboveandshall(ifrequired)allowaVeterinarySurgeonappointedbytheVendortoexamineand
trythebullandinadditionshall(ifrequired)allowtheVendortoremovethebulltotheVendor’sownorother
premisesinordertotrythebull.
(f)IntheeventoftheVendorandthePurchaserfailingtoagreeonwhetherornotthebulliscapableofputting
acoworheiferinastateofpregnancyinaccordancewiththeforegoingprovisions,orintheeventofany
otherdisputearisingbetweenthepartiesconcerningtheimplementationorinterpretationofthisagreement,
thesaiddisputeshallbeandisherebyreferredtoarbitrationbyasinglearbitrator,tobeagreedbetweenthe

VendorandthePurchaser(orindefaultofagreementtobenominatedbythePresidentforthetimebeingof
theIncorporatedLawSocietyofIreland),sucharbitrationtobeconductedinaccordancewiththeArbitration
Acts1954and1980.Theaforementionedreferraltoarbitrationshallbeaconditionprecedenttothe
commencementofanyotherlegalaction.
(g)IntheeventoftheVendorandPurchaser(orindefaulttheArbitrator)concludingthatabullisincapable
ofputtingacoworheiferinastateofpregnancyinaccordancewiththeforegoingprovisionsofthis
Agreement,thentheVendorshall(i)Beboundtoacceptthereturnofthebullandondeliveryofittohis
premises(unlesssomeotherarrangementsshallbemutuallyagreedupon)torefundtothePurchaserthe
wholeofthepurchasepriceofthebulltogetherwiththeexpensesofthePurchaser’sVeterinarySurgeons,the
costofcarriagefromthePurchaser’spremisestotheVendor’spremises,thecarriageandkeepofthebullfrom
thedateofnotificationoftheclaim,providedhoweverthatsuchexpensesandcostsshallnotexceedan
amountequalto10%ofthesalepriceofthebull.(ii)Paythecostsofthearbitrationandthearbitratorin
accordancewithanydirectiongivenbythearbitratorinthisregard.SaveasaforesaidtheVendorshallnotbe
underanyliabilitywhatsoevertothePurchaserinrespectoflosssustainedbythePurchaserhoweverthisloss
arisesandwhetheritbeconsequentialorotherwise.
(h)TheSocietyand/ortheAuctioneershallnotbeunderanyliabilitywhatevertothePurchaserinrespectof
anylosssustainedbythePurchaserhowsoeverarising,whetheritbeconsequentialorotherwise.
7. BREEDINGGUARANTEE-FEMALES
Anycoworheiferrealising500gns.ormorethatisstatedbytheVendorashavingbeenservedorartificially
inseminatednotlessthan12WEEKSbeforethedateoftheSaleshallbeguaranteedincalftotheservicedate
ordateofartificialinseminationandtothebullstated,unlessanyalterationtotheserviceparticularsis
announcedfromtherostrumorbytheVendoratthetimetheanimalissold.Theterm“runningwiththeBull”
impliesnoguaranteeofpregnancyunlessspecificallystatedbytheVendoratthetimeofsale,neithershallthe
provisionbytheVendorofacertificateofpositivepregnancyimplyanysuchguarantee,thisbeingmerelyan
expressionofopinion.Everyheifersoldasunservedshallbesoguaranteedandallsuchheifers(unlesssold
sucklingtheirdams)shallcarryaguaranteethattheyarecapableofbreeding.Calvessoldsucklingtheirdams
aregiventothePurchaserfreeandnoguaranteesapplyunlessspecificallybytheVendoratthetimeofsale.
NoclaimundertheseRuleswillbeeffectiveunlessmadetotheAuctioneerortotheVendorwithinthe
followingtimelimits,asapplicable,viz:
(a)InthecaseofacoworheifersoldasbeingincalfwhichprovesNOTtobeincalf-within49daysofthedate
ofsale.
(b)Inthecaseofacoworheiferwhich,althoughincalf,doesnotcalvetothestatedserviceorinsemination
date-withinTWOCALENDARMONTHSofthedatethattheanimalshouldhavecalvedaccordingtothe
particularsofserviceorinseminationstatedinthecatalogueofsale.Inallsuchcasesnoclaimwillbe
admissableunlessthereisanintervalofmorethanfourweeksbetweenthepresumedduedate(according
tothestatedparticularsofserviceorinsemination)andtheactualcalvingdate.Note:Theaveragegestation
periodforcattleis283days.
(c)InthecaseofacoworheiferwhichproducesacalftoadifferentbulltothatstatedbytheVendor-within
48hoursofthecalvingdatesuchinformationtobesubmittedtotheAuctioneersorVendorbytelephoneor
telegramandsubsequentlyconfirmedinwriting.NOTE:Whereacoworheifercalvesatalaterdatethanthe
duedatetheonusofprovingtheidentityoftheservicebullshallbeupontheVendor.
(d)Inthecaseofaheifersoldasunservedandwhichsubsequentlyprovestobeincalf-withinSIXCALENDAR
MONTHSofthedateofsale.
(e)Inthecaseofamaidenheiferwhichprovesincapableofbreedingbecauseofmalformationorabnormality
ofthegenitalsystem-notbeforetheanimalattainstheageofTWENTYSEVENMONTHSandnoclaimunder
thisRulewillbeadmissableaftertheanimalhasattainedtheageofTHIRTYMONTHS.
(f)Anyfemale(coworheifer)thathasbeenflushedforembryotransplantwillbeEXCLUDEDfromtheterms
ofthisguaranteebutindividualVendorsofsuchanimalsshallhavetheoptionofgivingtheirpersonal
guarantee,tobeannouncedatthetimeofsale.
NoclaimwillbeadmittedundertheseRuleswhereitcanbeprovedthatacoworheiferiscarryinga
mummifiedcalf,orhasabortedorre-abortedafoetusandnoguaranteeisgivenorimpliedthatanycowor
heiferwillcarryacalffull-time.
AllclaimsmustbesubmittedtotheVendorandtheSecretaryoftheSocietyandshallberesolvedin
accordancewiththeprovisionsofClause6(f)ofthisAgreement.
8. ThisAgreementshallbeinterpretedinaccordancewiththelawoftheRepublicofIreland.
