About The Origins of Biblical Law: The Decalogues and the Book of the Covenant

Calum M. Carmichael here offers a radically new interpretation of the law of ancient Israel. In Carmichael’s view, the rules of the Mishpatim (the laws of the Book of the Covenant, Exod 21:2-23:19) were not created directly in response to contemporary social problems, but rather may be traced back to literary traditions preserved in the books of Genesis and Exodus.Building upon his earlier book Law and Narrative in the The Evidence of the Deuteronomic Laws and the Decalogue, Carmichael demonstrates that a major motivation for biblical scribal art was to create a body of law specific to Israel’s national traditions. He shows how scribes who produced the laws of the Pentateuch drew upon the ethical and legal implications of the stories of Adam and Eve; Cain and Abel; Jacob, Esau, and Laban; Joseph and his brothers; and the exodus. Of particular interest is his discussion of the literary unit known as the Ten Commandments. Carmichael argues that God’s action in a story is transformed in this unit into a rule consistent with the judgment implicit in the narrative.Observing the complex limits between law-making and storytelling, Carmichael sets forth a challenging new hypothesis of how the Bible was constructed. The Origins of Biblical Law will be welcomed by biblical scholars, legal historians, anthropologists, ancient historians, literary theorists focusing on narrative, and readers interested in Judaica.
