A QUATRIÈME CONFÉRENCE biennale de la Société européenne de droit
international, tenue à l’invitation du Professeur James Crawford et de son équipe
du Lauterpacht Centre for International Law, et dont le présent ouvrage rend
disponibles la plupart des meilleures communications qui y ont été faites, a été un très
grand succès. Tous les ingrédients étaient réunis à cette fi n : un thème général stimulant
décliné en de multiples sujets permettant de capturer les aspects les plus actuels de
l’évolution du droit international, un auditoire nombreux mêlant toutes les générations,
les spécialités, les nationalités, dans un lieu prestigieux empreint d’histoire et à l’avant-
garde de la réfl exion sur le droit international. Comme on pouvait s’y attendre et comme
cet ouvrage en porte témoignage, une réfl exion et une évaluation d’ensemble portant sur
l’évolution du droit international au cours des deux dernières décennies a autant soulevé
de questions qu’apporté de réponses. Elles ont, en toute hypothèse, donné l’occasion
d’un vaste partage d’idées et de l’expression d’une belle diversité.
Cela correspond précisément à la vocation de la Société européenne qui puise dans
chacun de ces événements et dans les publications auxquelles ils donnent lieu un
dynamisme renouvelé. Nous souhaitons à cet ouvrage un destin éditorial à l’image
du succès qu’a été la Conférence de Cambridge. Nous souhaitons qu’il donne envie à
ceux qui ne le sont pas encore de devenir membres de la Société Européenne de Droit
International et de participer à ses activités.

HE FOURTH BIENNIAL conference of the European Society of International
Law demonstrated the extent to which international law has become a subject
of ever-growing and now widespread attention. These conference proceedings
demonstrate how, during the years 1989–2010, international law has expanded in range,
substance, depth and technique. There are, for instance, new techniques for treaty making
and for dispute settlement, none of which were dreamt of in the fi rst decades of the last
century. The great international lawyers of those days would surely be both surprised and
pleased to see the vibrancy of their subject. The proceedings here recorded will no doubt
keep the debates at ESIL 2010 alive for many years.
