NOTICE OF AMENDMENTS
The following six pages refer to amendments made to the Town ofDuxbury Zoning Bylaws at
the March 2000 Annual Town Meeting.
These Amendments have been approved by the Massachusetts Attorney General's Office.

Annual Town Meeting held on Saturday, March 11,2000 at 9am and rdcessed at 5:23pm
until Monday, March 13th at 7:30pm until the adjournment of the meeting at 10:47pm
all at the Duxbury Middle School, T. Waldo Herrick Memorial Gyinnasium, St. George St,
Duxbury, MA A Special Town Meeting was held within the ATM from 9:15am until the
adjournment of the STM sine die at 9:28am. The ATM recessed at 12:47pm and
reconvened at 1:55pm. on Saturday, March 11th for lunch..
Article 33-Moved and seconded chat L!\e Town vote to ajuend the Protective Bylaw ofthe Town of
Duxbury by amending Section 406 entitled "Aquifer Protection Overlay Districts" under Anicle 400 Use
Regulations by adding language that will bring the Bylaw into confonnance with the DEP Wellhead
Protectjon Model Bylaw specifically amending the following Subsections;
Section 406.3 Use Regulations by adding a second subheading entiUed "2. FloorDrains" and
inserdng the following language so that the new subheading reads as follows:
"2. Floor Drains. Any floor drainage system in facilities, in industrial or conumercial process areas
or hazardous material and/or hazardous waste storage areas, wliich discharges to the ground
withouta DEP permit or authorization is prohibited. Any facility with such a drainage system
shall be required to either seal the floor drain (in accordance with the State Plumbing Code 248
CN'IR 2.00); connect the drain to a municipal sewer system (with all appropriate permits and pre-
txeatment); orconnect the drain to a holding tank meeting the requirements ofall DEP
regulations and policies."
And Section 406.5 Special Permit Uses by adding a fourtli itnd fifth item each with the respecdve
following language;
"4. Storage ofcommercial fertilizer, as defined in MGL c.128. s. 64. provided such storage is within
a structure designed to prevent the generation and escape ofcontaminated runoffor leachate.
5. Storage ofanimal manure, provided such storage is covered or contained in accordance with the
specifications ofthe U.S. Soil Conservation Service."
And Section 406.7 Design and Operations Guidelines by adding a fifth subheading so that the new
subheading reads as follows:
"5. Earth Removal. The removal ofsoil, loam, sand, gravel, or any other mineral substance shall not
be permitted within four feet oftlie historical high groundwater table elevation (as determined
from monitonng wells and historical water table fluctuation data compiled by the US Geological
Survey), unless substances removed are re-deposited within Ibrty-five (45) days on sue to achieve
a final grading greater dian four (4) feet above the histoncal lugh water mark, and e.xcept for
e.xcavations for the consiniction ofbuilding foundations or tlie installation of utility works."
.A report was given by the planning Board.

Article 35-moved and seconded that theTownvote to amend the Protective Bylaw ofthe Town of
DiLxbuiy to clarify Section 703.5 "Neighborhood Access" under Article 700 Design Standards forPlanned
Development andResidential ClusterDevelopmentby inserting a period afterthe word "permitted" in the
second sentence and deleting the rest ofthe sentence after the word "permitted" so that Section 703.5
reads as follows:
"No development shall reduce vehicular access to an e>dsting neighborhood. The extension of
existing cul-de-sac streets to serve a planned development or residential cluster development
shall notbe permitted."
A reportwas given by the PlanningBoard.
Ahearing was held by the Planning Board.
Voted-March 13,2000
2/3 vote required. Motion carried unanimously.
