Inttoductton
Delhi is a Union territory with a Legislative Assembly
and a Council of Ministers. Out of the 29 States and 7 Union
territories which put together constitute the territory of
India, Delhi is the only exception for the governance of
which separate provisions have been made in the
Constitution . This has been felt necessary because Delhi is
the Capital of India and the Central Government cannot
therefore abdicate the responsibility in the matter of
governance of and control over its own capital.
Constitutionally named as the 'National Capital
Territory', Delhi is governed by three sets of instruments.
These are:
(i) the Constitution of India (article 239AA and
239AB);
(ii) Law enacted by Parliament to supplement the
Constitutional provisions (Government of NCT of
Delhi Act); and
(iii) the Rules of Business (viz . (i) the Allocation of
Business Rules and (ii) the Transaction of Business
Rules.
The core features of Delhi's political and administrative
•
set-up have been incorporated in the Constitution itself.
This has been done purposely so as to accord a certain
degree of stability and permanency to these arrangements.
A separate law known as the Government of NCT of Delhi
Act enacted by Parliament supplements the constitutional
provisions relating to the Legislative Assembly and the

Council of Ministers. In addition, Rules of Business (a piece
•
of subordinate legislation) have also been framed for
conducting the day-to-day affairs of the administration.
The salient features of Delhi's political set-up are as
follows:-
(i) The Union Territory of Delhi is called the National
Capital Territory of Delhi and the Administrator
thereof is designated as the Lieutenant Governor.
(ii) Delhi is a Union Territory with a Legislature and a
Council of M.inisters headed by a Chief Minister.
(iii) Delhi Legislative Assembly is empowered to make
laws on any matters enumerated in the State List
or in the Concurrent List in so far as any such
matter is applicable to the Union Territory, except
matters with respect to entries 1,2 and 18, Viz.
'Public Order', 'Police' and 'Land' of the State List.
(iv) The power conferred on Delhi Legislative
Assembly to make laws shall not derogate from
the powers of Parliament under the Constitution
to make laws with respect to any matter of a Union
Territory (In other words, Parliament is not
prevented from enacting at any time any law with
respect to the same matter so made by the
· Legislative Assembly).
This book, which describes the polity and the method
of governance of India's capital city, is the outcome of
meticulous study, painstaking research and practical
experience of authors who have been actors and performers
in different political set ups Delhi had at different points of
time. While one of the authors was himself once a presiding
officer in the seventies and eighties, the other author
rendered behind-the-scene guidance, assistance and advice
to the political functionaries when Delhi was granted a new
set up under the Constitution in the early nineties. As such,
they have been witness to, participators in and even creators
and adjudicators of many events and developments having

a direct or indirect bearing on the existing administrative
structure of Delhi.
Delhi is not only widely perceived to be but even
acknowledged as the heart of India. Every political party
whatever be its complexion-which wishes to control its
heartbeat by fixing its own pacemaker, invariably promises
grant of full statehood to it before the elections. However,
the promise is never realised afterwards.
It is hoped that the publication would be found useful,
informative and an authentic source of reference by all those
interested in understanding the manner in which India's
national Capital is governed.
