This Sixth Edition has been significantly updated to reflect the developments in environmental law since 1997, and it covers the significant developments as of February 1, 2004.Pennsylvania Environmental Law Handbook, Sixth Edition focuses on Pennsylvania environmental law including its statutes, regulations, informal guidance, and its common law developments as reflected by administrative and Court decisions. Also included are those areas with an impact on Pennsylvania business over which the federal government retains primary responsibility or that closely interact with or supplement state programs. Chapter II discusses the separation of the Department of Environmental Resources into the Departments of Environmental Protection (DEP) and Conservation and Natural Resources (DCNR) and DEP's internal reorganization. The Environmental Hearing Board's revision to its rules is also addressed. Chapter III, pertaining to Air Pollution, reflects actions taken at both the state and federal level to continue implementation of the federal 1990 Clean Air Act Amendments, including the July 9, 1992 amendments to Pennsylvania's Air Pollution Control Act. The operating permit program for stationary sources and the mobile source emission controls are among the recent changes addressed. Chapters IV and V, covering Water Pollution and Coastal Zones, Water Obstructions, and Wetlands, has been updated to include discussions of the anitdegradation rules, the amendments to the Sewage Facility Act, and the new PA General Permit issued by the Corps of Engineers and other wetland regulatory changes.The changes to Chapter VI reflect amendments to and promulgation of laws applicable to Solid and Hazardous Waste.
