considerationsandpracticalexperiences.Theseconddiscussionpaperpresentsthelegalaspectsofthe
managementofsharedfishstocksincludingrelevantprovisionsinthe1982UNConventiononthe
LawoftheSeaandotherinternationallegalinstruments.Thecasestudiespresentexperienceswiththe
managementofsharedfishstocksfromvariousregionsoftheworld.Thecasestudiesidentitycritical
successfactorsinthevariousstagesandforthevariousfunctionsofcooperativemanagement
includinginformationexchangeandsharing,negotiatingagreements,implementationproceduresand

INTRODUCTION
TheGovernmentofNorway,incooperationwithFAO,istoholdanExpertConsultationonthemanagement
ofsharedfisheryresources.TheConsultationisbeingconvenedinrecognitionofthefactthatthe
managementoftheseresourcesstandsasoneofthegreatchallengesonthewaytowardsachievinglong-term
sustainablefisheries.TheobjectiveoftheExpertConsultationistoassistcountriesinimprovingtheir
efficiencyandperformanceinmeetingthischallenge.
ThispaperisdesignedtoserveasoneofseveralbackgrounddocumentsfortheExpertConsultation.As

academicaspectsinanon-technicalmanner,andgoontoillustratekeypointsarisingfromtheacademic
analysis,bydrawinguponbriefcasestudiesfromtherealworld.Itisanticipatedthatallofthecasestudies

SomeDefinitions
Theterm"sharedfishstocks”isunderstood,bytheFAOandothers,toincludethefollowing:
(a)fishresourcescrossingtheexclusiveeconomiczone(EEZ)boundaryofonecoastalStateinto
theEEZ(s)ofone,ormore,othercoastalStates transboundarystocks
(b)highlymigratoryfishstocks,which,duetotheirhighlymigratorynature,aretobefound,both
withinthecoastalStateEEZandtheadjacenthighseas
(c)allotherfishstocks(withtheexceptionofanadromoux'catadromousstocks)thataretobefound,
bothwithinthecoastalStateEEZandtheadjacenthighseas-straddlingstocks
(d)fishstockstobefoundexclusivelyinthehighseas
Clearly,thesecategoriesarcnotmutuallyexclusive.Onecanfindmanyexamplesoffishstocksthatfallinto
category(b),orcategory(c),whichalsofallintocategory(a).Bethatasitmay,itistheexpressintentionof
