The 14th January, 2016
S.R.O. No.46/2016—Whereas, the draft of certain rules further to amend the
Odisha Municipal Corporation Rules, 2004 was published as required by sub-section (1) of
Section 656 of the Odisha Municipal Corporation Act, 2003 (Odisha Act,11 of 2003) in the
Extraordinary issue No. 1802, dated the 30th December, 2015 of the Odisha Gazette
under the notification of the Government of Odisha in the Housing and Urban
Development Department No. 33457-HUD-13-LEGIS-67-POLICY-48/2015, dated the 30th
December, 2015 bearing S.R.O. No. 623/2015 inviting objections and suggestions from all
persons likely to be affected thereby within a period of ten days from the date of
publication of the said notification in the Odisha Gazette;
And, whereas, the suggestion received by the Commissioner-cum-Secretary to
Government in respect of the said draft within the stipulated period have been duly
considered by the State Government;
Now, therefore, in exercise of the powers conferred by sub-section (1) of
Section 656 of the said Act, the State Government do hereby make the following rules
further to amend the Odisha Municipal Corporation Rules, 2004, namely: —
1. (1) These rules may be called the Odisha Municipal Corporation (Amendment)
Rules, 2016.
(2) They shall come into force on the date of their publication in the Odisha Gazette.
2. In the Odisha Municipal Corporation Rules, 2004, after Chapter-VII, the following
Chapter shall be inserted, namely: —
“Chapter-VIII
Disqualification on the ground of defection
50. Manner of filing of complaint— (1) A complaint for decision relating to
disqualification on the ground of defection under section 112 A shall be made to the
Election Commission.

(2) The complaint under sub-rule(1) may be made in writing to the Election
Commission by any Corporator or the Political Party.
(3) Before making any complaint in relation to any Corporator, the complainant shall
satisfy himself that there are reasonable grounds for believing that a question has
arisen as to whether such Corporator has become subject to disqualification under
section 112A .
(4) Every complaint shall,—
(a) contain a concise statement of the material facts on which the complainant
relies; and
(b) shall be accompanied by copies of the documentary evidence, if any, on
which the complainant relies.
(5) Every complaint shall be signed by the complainant and verified in the manner
laid down in the Code of Civil Procedure, 1908 (5 of 1908), for the verification of
pleadings.
(6) Annexure, if any, to the complaint shall also be signed by the complainant and
verified in the same manner as the complaint.
(7) The complainant has to indicate clearly the name and address of the Corporator
along with the ward he represents and the name of the political party by which he has
been set up as a candidate for the election as a Corporator.
(8) Every complaint under sub-section (1) of Section 112 D shall be disposed of by
the Election Commission in accordance with the procedure as applicable while trying a
suit under the Code of Civil Procedure, 1908 and the Election Commission, while
deciding such complaint shall have the powers of a Civil Court in respect of the
following matters, namely: —
(a) summoning and enforcing the attendance of any person and examining
him on oath;
(b) requiring the discovery and production of any document or other
materials that may be produced as evidence;
(c) receiving evidence on affidavits; and
(d) requisitioning any public record or copy thereof from any office.” .
