Minutes of 26th meeting of Expert Appraisal Committee held on 27-28 July, 2017 for
appraisal of projects related to Industry-II at Ministry of Environment, Forest and
Climate Change, Indira Paryavaran Bhawan, Jor Bagh Road, New Delhi

Day 1: 27th July, 2017

1. Opening remarks of the Chairman

2. Confirmation of the minutes of the 25th meeting held on 5-7 July, 2017 at N Delhi

The EAC, having taken note that no comments were offered on the minutes of its 25th
meeting held on 5-7 July, 2017 at New Delhi, confirmed the same.

3. Consideration of proposals

26.3.1 Expansion of Cosmeceutical, Active Pharmaceuticals, Specialty Chemicals and
Biotech Products manufacturing at Hassan (Karnataka) by M/s Kumar Organic
Products Limited - For EC

26.3.1.1 The project proponent and their accredited consultant M/s Hubert Enviro Care
Systems (P) Ltd, gave a detailed presentation on the salient features of the project
and informed the following:-

i. The proposal is for “Expansion of Cosmeceutical, Active Pharmaceuticals,
Specialty Chemicals and Biotech Products manufacturing at Hassan
(Karnataka) by M/s Kumar Organic Products Limited.
ii. All Synthetic Organic Chemicals Industry located in a notified industrial
area/estate are listed at S.N. 5(f) of Schedule of Environmental Impact
Assessment (EIA) Notification under Category ‘B’. However, due to non
functioning of SEIAA, Karnataka, the project has been considered under
category ‘B’ and appraised at Central level by Expert Appraisal Committee
(EAC).
iii. The PP had earlier obtained EC vide letter No. SEIAA:102:IND:2008 dated
18th March 2011.
iv. Existing land area is 25 acre, and no additional land is not required for the
proposed expansion.
v. Industry has already developed greenbelt in an area of 33% i.e., 8.25 Acres out
of 25 Acre of area of the project, and will improve the Greenbelt by planting
more number of trees.
vi. The estimated project cost is Rs. 25 Crores including existing investment of Rs
5 Crores. Total capital cost earmarked towards environmental pollution control
measures is Rs 1.6 Crores and the recurring cost (operation and maintenance)
will be about Rs11.2 Lakhs/Annum.
vii. Total Employment will be for 103 persons as direct & 110 contract persons as
indirect after expansion. Industry proposes to allocate Rs 62.5 Lakhs @ of 2.5
% towards Corporate Social Responsibility.

viii. No National parks, Wildlife sanctuaries, Biosphere reserves, Tiger/Elephant
reserves, Wildlife corridors etc. lies within 10 km distance. Yagachi river (7.45
Km, W), Hemavathi river (14.9 Km, SSE) & Hemavati reservoir (13.26 Km,
SW) are located within 10 km distance from the project site.
ix. Ambient air quality monitoring was carried out at 8 locations during September
– November, 2016 and the baseline data indicates the ranges of
concentrations as: PM (42.7– 58.7µg/m3), PM (18.4 - 26.3 µg/m3), SO
10 2.5 2
(10.2 - 16.6 µg/m3) and NO (15.5 – 24.3 µg/m3). AAQ modelling study for point

source emissions indicates that the maximum incremental GLCs after the
proposed project would be 0.35 µg/m3, 1.92 µg/m3 and 2.19 µg/m3 with respect
to PM , SO and NO . The resultant concentrations are within the National

Ambient Air Quality Standards (NAAQS).
x. Total existing water requirement is 365 m3/day of which fresh water
requirement of 103 m3/day will be met from KIADB.
xi. Effluent of 262 m3/day will be treated through ETP&MEE. Plant will be based
on Zero Liquid discharge system.
xii. Power requirement after expansion will be 1000 KVA including existing 500
KVA and will be met from CHESCOM. Existing unit has 1 DG sets of 500 KVA
capacity (used during power failure). Stack (height11m AGL) will be provided
as per CPCB norms to the proposed DG sets of 1x500 KVA (standby during
power failure) in addition to the existing DG sets.
xiii. Existing unit has 4 TPH briquettes fired boiler. Multi cyclone separator/ bag
filter with a stack of height of 35 m AGL will be installed for controlling the
particulate emissions (within statutory limit of 115 mg/Nm3) for proposed 8
TPH briquettes fired boiler.
xiv. Total municipal solid waste generated during the construction phase will be 15
Kg/day for total 30 Nos manpower. Total municipal solid waste generated
during the operation phase will be 106.5 Kg/day for total 213 employees. The

xv. Public hearing is exempted as per para 7(i) III Stage (3)(i)(b) of EIA

Notification, 2006 for preparation of EIA/EMP Report, as the site is located in

the notified industrial area.

26.3.1.2 During deliberations on the proposal, the EAC noted the following:-

(i) The organic chemical manufacturing unit with the present capacity of 2702 TPA
of M/s Kumar Organics Products Ltd, at the existing premises of a total area of 25

acres at Plot No.94 (P), 103 & 104, KIADB industrial area, District Hassan
(Karnataka) was earlier accorded EC by SEIAA on 18th March, 2011 stipulating
certain terms and conditions for environmental safeguards.

(ii) The ToR for the expansion project involving increase in production capacity from
2702 TPA to 5796 TPA was granted by SEIAA vide letter dated 24th September, 2016
with the exemption from public hearing due to being located in notified industrial area
under the administrative control of KIADB.

(iii) The project/activity is covered under category B of item 5 (f) of the Schedule to
the EIA Notification, 2006. However, due to SEIAA not in existence in this State, the
project was considered at the Central level.

(iv) The Regional Office of the Ministry at Bengaluru carried out the site visit on 8th
June, 2017 for monitoring compliance status of the EC conditions. The Committee
observed that many of the EC conditions are not complied with.

26.3.1.3 The Committee, after detailed deliberations, insisted for true compliance of the EC
conditions and not to take the proposal forward till the firm action plan for corrective
actions, is submitted by the project proponent to the Regional Office and the same is
forwarded to this Ministry after their endorsement. The proposal was, therefore,
deferred.

26.3.2 Expansion of ‘Carbon black, Coal tar pitch, Naphthalene, Sulfonated
Naphthalene Formaldehyde (SNF)/Dispersion Agent, Poly Carboxylate Ether,
Heavy and Light Creosote Oil, Tail Gas’ at JL No.103, Mouza & Village Mahiskry,
District Hooghly (WB) by M/s Himadri Chemicals & Industries Ltd - For EC

26.3.2.1 The project proponent and the accredited consultant M/s Hubert Enviro Care Systems
(P) Ltd, Chennai, has made a detailed presentation on the proposal and informed the
following:-.
i. The proposal is for expansion of ‘Carbon black, Coal tar pitch, Naphthalene,
Sulfonated Naphthalene Formaldehyde (SNF)/Dispersion Agent, Poly
Carboxylate Ether, Heavy and Light Creosote Oil, Tail Gas’ at JL No.103,
Mouza & Village Mahiskry, District Hooghly (West Bengal) by M/s Himadri
Chemicals & Industries Ltd.

ii. The ToR letter was issued vide Ministry’s letter no.J-11011/182/ 2015-IA II (I)
dated 7th September, 2015 and amended vide letter dated 2nd February, 2016.

iii. The proposal is classified under Schedule 4b(ii), 5(e) and 5(f) of Environmental
Impact Assessment (EIA) Notification no 1331 dated 25th June 2014, under
category ‘A’ and are appraised at Central Level by Expert Appraisal Committee
(EAC).
iv. The existing plant was set up before Ministry’s notification no-1331 dated 25th
June 2014, as such EC was not required. However as per direction of Hon’ble
NGT, application for post facto EC for the existing plant is submitted.

v. Ministry had issued EC earlier vide letter no. EN/2060/T-II-I/059/08, dated 19th
September 2008 for 12 MW Captive Power Plant in favour of M/s Himadri
Chemicals & Industries Limited.

vi. Presently existing total land area is 142393 sqm. Total coverage area after the
proposed expansion will be 96090.7 sqm. No additional land will be required.

vii. Industry has already developed Greenbelt in an area of 30% i.e.42718 sqm.
After expansion, green belt will be 32.23% i.e. 45902.3 sqm out of 142393
Sq.m area of the project.

viii. The estimated project cost is Rs.400 Crores. Total capital cost earmarked
towards environmental pollution control measures is Rs.21.9 Cr and the
Recurring cost (operation and maintenance) will be about Rs. 0.6 Cr/annum.

ix. Total employment will be for 2000 persons as direct & 1500 persons indirect
after expansion. Industry proposes to allocate Rs. 10.0 Crore (2018 – 2023) @
of 2.5 % towards Corporate Social Responsibility.

x. No National parks, Wildlife sanctuaries, Biosphere reserves, Tiger/Elephant
reserves, Wildlife corridors etc. lies within 10 km distance. Ghiya River (700 m)
and DVC Canal (7.27 km) are within 10 km distance from the project site.

xi. Ambient air quality monitoring was carried out at 8 locations during October
2015 to January 2016 and the baseline data indicates the ranges of
concentrations as: PM10 (68-92 µg/m3), PM2.5 (39-51µg/m3), SO2 (5.4-15
µg/m3) and NO2 (6.8-41 µg/m3). AAQ modeling study for point source
emissions indicates that the maximum incremental GLCs after the proposed
project would be 92.3 µg/m3,15.5 µg/m3 and 41.5 µg/m3 with respect to PM10,
SOx and NOx. The resultant concentrations are within the National Ambient Air

Quality Standards (NAAQS).

xii. Total existing water requirement is 1748 cum/day (1268 m3/day from ground
and 480 m3/day recycled). After expansion, total requirement will be 2681
m3/day (1968 m3/day from ground and 713 m3/day will be recycled) and will be
met from the existing bore well. The PP is having approval for drawing 3600
m3/day of raw water.

xiii. Treated effluent of 31 m3/day is treated through CETP will be reused in Carbon
black Quenching process. Plant will be based on zero liquid discharge system.
xiv. Total power requirement after expansion will be 12.5 MW/Hr including existing
8 MW/Hr and will be met from onsite tail gas based cogeneration power plant.
There shall be tail gas based Co-Generation Plants with an output of 12 +8+ 8
MW. (Total 28 MW). After captive consumption, Balance power available shall
be exported /sold to WBSEDCL. Existing unit has 6 no DG sets of capacity- 4
x725 KVA, 1x365 KVA & 1x1010 KVA. These DG sets will be used only during
power failure. Stacks height 10.6 m are provided as per CPCB norms.

xv. Existing unit has 2x40 TPH tail gas fired Boiler with PCME and a stack of
height of 73 m is already installed (Within statutory limit of 115 mg/Nm3). For
proposed expansion 1x 40 TPH tail gas fired boiler will be installed.

xvi. Details of process emissions generation and its management are as under:-

xviii. Arrangement with TSDF (Ramky-authorized agency of SPCB) for disposal of all

hazardous solid waste has been made and Hazardous waste authorization

from WBPCB is also obtained for the disposal of waste generated from existing

operation of the entire chemical complex.

xix. Public Hearing for the proposed project has been conducted by the West

Bengal Pollution Control Board on 12.11.2016.

xx. The Compliance report of Eastern Regional office, Bhubaneswar dated

01.06.2017 has been submitted.
xxi. There is no litigation pending against the proposal. However, there was a case
in relation to applicability of EC before National Green Tribunal which has been
settled in favor of PP. Original Application No. 77/2014 Subhas Dutta Vs
Himadri Chemicals, MOEF & CC & others and Original Application No.
109/2014 Mahistikry Paribesh Jivan O Krishi Kalyan Mancha & Other Vs
Himadri Chemicals, MOEF & CC& others. This was settled in favor of Himadri
Chemicals and Industries Ltd.
xxii. The existing and proposed units associated with the project are as under:-

26.3.2.2 During deliberations on the proposal, the EAC noted the following:-

(i) The earlier environmental clearance for 12 MW Captive Power Plant was granted
on 19th September, 2008 by the SEIAA in favor of M/s Himadri Chemicals & Industries
Ltd, for their Carbon Black manufacturing project in a total area of 142393 sqm at J L
No.103, Mouza & village, Mahisikry, Taluka Harpal, District Hooghly (West Bengal),
stipulating certain terms and conditions for environmental safeguards.

(ii) Different products being manufactured within the plant namely, Carbon Black,
Coal tar pitch, Naphthalene, Sulfonated Naphthalene Formaldehyde (SNF), Heavy
and Light Creosote Oil and Tail Gas, were not covered under the original EIA
Notification, 2006, and as such no prior EC was obtained for the same.

(iii) The project/activity was brought under the ambit of the EIA Notification, 2006
vide amendment dated 25th June, 2014 in the Principal Notification, and now covered
under category A of item 4 (b), 5 (e) and 5 (f) of the Schedule to the said Notification.

(iv) The ToR for the proposed increase in production of Carbon Black, Coal Tar
Pitch, Naphthalene, Sulfonated Naphthalene Formaldehyde/Dispersion Agent Phenol
Based/PCE, Heavy and Light Creosote Oil, Tail Gas’ was granted by the Ministry vide
letter dated 7th September, 2015. As per the conditions specified in the ToR, public
hearing was conducted on 12th November, 2016.

(v) In the Civil Appeal No.9220 of 2016 in the matter of ‘Mohistikari Paribesh Jivan
O Krishi Kalyan Mancha and Anr Vs MoEF&CC and Ors’ against the order of the NGT
(EZ) in OA No.77/2014 & 109/2014, Hon’ble Supreme Court of India vide order dated
30th September, 2016 has upheld the orders of Hon’ble NGT. Hon’ble Court has
further made it clear that neither the order passed by the Tribunal nor the present
order shall prevent anyone aggrieved of any pollution allegedly caused by the unit
from complaining to the Tribunal or seeking redress nor shall the said orders come in
the way of Tribunal in examining any such allegation on its merit and passing
appropriate orders.

(vi) Total water requirement will be increased from 1748 cum/day to 2681 cum/day
after the expansion. Out of it, 1968 cum/day shall be met through ground water and
713 cum/day shall be the recycled water.

(vii) The Regional Office of the Ministry has carried out the site visit for monitoring
compliance status of the EC conditions and forwarded their report on 1st June, 2017.
The Committee observed that many of the EC conditions have been complied with.

26.3.2.3 The EAC, after deliberations on the proposal, submissions made by the project
proponent and the EC compliance report, recommended the project for grant of
environmental clearance, subject to compliance of specific conditions as under:-

 Consent to Establish/Operate for the project shall be obtained from the State
Pollution Control Board as required under the Air (Prevention and Control of
Pollution) Act, 1981 and the Water (Prevention and Control of Pollution) Act, 1974.
 As already committed by the project proponent, Zero Liquid Discharge shall be
ensured and no waste/treated water shall be discharged outside the premises. The
effluent discharge, if any, shall conform to the standards prescribed under the
Environment (Protection) Rules, 1986.
 Necessary authorization required under the Hazardous and Other Wastes
(Management and Trans-Boundary Movement) Rules, 2016, Solid Waste
Management Rules, 2016 shall be obtained and the provisions contained in the
Rules shall be strictly adhered to. Prior permission from the WBSPCB shall be
obtained for disposal of solid/hazardous waste in the TSDF.
 National Emission Standards for Organic Chemicals Manufacturing Industry issued
by the Ministry vide G.S.R. 608(E) dated 21st July, 2010 and amended time to time
shall be followed by the unit.
 Multi-cyclone followed by bag filter shall be provided to the coal fired boiler to
control particulate emissions within the permissible limit. The gaseous emissions
shall be dispersed through stack of adequate height as per CPCB/SPCB
