Im Kontext der aktuellen Wirtschafts- und Finanzkrise gewinnt die Frage nach der Zukunft der europäischen Integration besondere Brisanz. Verena Schäfer diskutiert anhand der durch den Vertrag von Lissabon erstmals reformierten Flexibilitätsklausel die Möglichkeiten einer weichen Konstitutionalisierung und der damit verbundenen vertragsimmanenten Fortentwicklung des Integrationsprozesses. Die Autorin erläutert den Sonderfallcharakter der zielbezogenen Handlungsermächtigung und analysiert, inwiefern diese im Zeitraum 1958-2012 von den Staats- und Regierungschefs der Mitgliedstaaten als Türöffner zur Erschließung neuer Handlungsbereiche auf europäischer Ebene genutzt wurde. Dabei zeigt sich, dass die vor allem von den deutschen Bundesländern lange kritisierte ‚Generalklausel’ in vielen Politikfeldern wirksam wurde. Anhand der Bereiche Umweltpolitik, Forschungs- und Technologiepolitik, Regionalpolitik, Verbraucherschutz, Entwicklungshilfe und Energiepolitik kann nachgewiesen werden, dass die Flexibilitätsklausel entscheidend zur Ausdehnung der sektoralen Dimension des Integrationsprozesses beigetragen hat.
