PROPOSED DEBTOR IN POSSESSION TERM LOAN AGREEMENT
PLEASE TAKE NOTICE that, in connection with the hearing scheduled to be
held on February 25, 2009 at 10:30 a.m. (prevailing Eastern time) before the Honorable Robert
E. Gerber, United States Bankruptcy Judge, in Room 621 of the United States Bankruptcy Court
for the Southern District of New York, One Bowling Green, New York, New York 10004, to
consider the motion, dated January 6, 2009 (the “Motion”), of Lyondell Chemical Company and
its affiliated debtors in the above-captioned chapter 11 cases, as debtors and debtors in
possession (collectively, the “Debtors”), for an order authorizing postpetition debtor in
possession financing [Docket No. 7], the Debtors hereby file substantially final drafts of the
schedules (the “Schedules”) referenced in the proposed Debtor in Possession Credit Agreement
(the “DIP Term Loan Agreement”) submitted in substantially final form on February 20, 2009
[Docket No. 869]. Copies of the Schedules are attached hereto as Exhibit A.
