1. Purpose and scope
This Archaeology and Cultural Heritage Sub Plan describes the existing archaeological and cultural heritage
conditions and management measures required to mitigate the potential negative impacts to archaeological
and cultural heritage sites (both Aboriginal and European) from the following phases of the Victorian
Desalination Project (VDP):
1. Design and construction (D&C)
2. Construction Verification and Cleaning
3. Pre-Commissioning & Commissioning
The D&C EMP Commissioning Environmental Sub Plan (CESP), includes the Commissioning Risk
Assessment which is used to manage unique/specific environmental risks from first intake of seawater into
the plant site onwards (‘Wet Commissioning’). As outlined by the CESP Risk Assessment, where the
activities or risks are common to both the D&C and Commissioning phases, the risks will be managed by this
sub plan and associated control measures.
A Cultural Heritage Management Plan (CHMP) has been prepared by Biosis Research Pty Ltd. This CHMP
been approved by Aboriginal Affairs Victoria (AAV) and therefore supersedes all preceding reports detailing
Aboriginal heritage previously supplied as technical references.
This sub plan must be read in conjunction with the approved CHMP (Technical Appendix 45), the
Environmental Management System (EMS) Manual, the D&C Environmental Management Plan (D&C EMP),
the D&C Plant and General Area EMP and the Commissioning Environmental Sub Plan (CESP). This sub
plan forms an attachment to the D&C Plant and General Area EMP and addresses requirements listed in the
Environmental Compliance Tracker (TDV-0-EV-RP-0001-01), including licence conditions, Performance
Requirements (PRs), Performance Criteria (PC) and other obligations which may influence the
archaeological and cultural heritage.
Specific management measures from this and other environmental sub plans have been incorporated into
Work Area Packages (WAP) and Work Packs (WP), which include Construction Work Method Statements
(CWMS), Site Environmental Plans (SEP) and Job Safety and Environmental Analysis (JSEA) where
applicable.
2. Objectives and Targets
The objective of this sub plan is to avoid or minimise harm to Aboriginal or non-Aboriginal sites or artefacts
during construction and to ensure project objectives, targets and obligations, including PRs and associated
criteria, are met.
Table 1 outlines the relevant archaeological and cultural objectives and targets to be achieved during the
D&C phase of the VDP. Numbered entries are applicable performance requirements taken from Schedule A
of Appendix S3 of the Project Deed. Non-numbered entries in Table 1 have been identified from the
approved CHMP.

All PRs from Project Deed Schedule A of Appendix S3 are contained within the D&C Plant and General Area
EMP Attachment G – Environmental Obligations Register. The Environmental Compliance Tracker tracks
conformance with these PRs and is updated regularly by the TDJV Environmental Manager and Area
Environmental Managers.
3. Legal, regulatory, licence, permits and approval requirements
Under the Project Deed the D&C EMP, all sub plans and any changes to these must be endorsed by the
State, who may refer aspects to relevant agencies.
The Department of Planning and Community Development (DPCD), which incorporates Heritage Victoria
(HV) and Aboriginal Affairs Victoria (AAV), the Department of Sustainability and Environment (DSE Capital
Projects) and other relevant stakeholders have been consulted with regard to development of the CHMPs
and implementation of the associated management recommendations. There were no Registered Aboriginal
Parties (RAPs) for any part of the activity area at the time of preparing the CHMPs, however three
organisations applied for RAP status for the activity area with Aboriginal Heritage Council. All three
organisations were consulted about the project and were invited to participate in fieldwork.
Approval of the CHMP means that no further permits/applications are required regarding Aboriginal
archaeological heritage sites. Provided recommendations and contingencies in the CHMPs are strictly
adhered to, no further measures or actions are required. The TDJV engaged a heritage and archaeological
consultancy to facilitate implementation of the Desalination Project, Desalination Plant and General Area,
Wonthaggi (CHMP 2009) on behalf of the project.
In relation to any historic site that may be impacted, a Consent/s to Destroy will be applied for from HV and
any associated conditions fulfilled.
The legislative and contractual requirements for the D & C Plant and General Area are summarised in:

4. Existing Conditions and Issues
4.1. Aboriginal Heritage sites
Prior to the commencement of the CHMP in August 2007, no previously recorded Aboriginal or historical
archaeological sites had been recorded on the heritage databases of Aboriginal Affairs Victoria (AAV) or
Heritage Victoria (HV) within the plant site. One Aboriginal site, Powlett River (8020-0001), had been
recorded on the foreshore dunes at the Powlett River mouth, more than 400m outside the plant Study Area,
and had been registered on the Victorian Aboriginal Heritage Register. A number of additional Aboriginal
shell midden sites had also been recorded during a survey by La Trobe University in 1985-7 on the foreshore
dunes which are located adjacent to the plant Study Area, but these had not been registered on the
Aboriginal Heritage Register.
As a result of field investigations undertaken between August 2007 and July 2008, nineteen Aboriginal sites
were originally recorded within the plant site, of which fifteen had not been previously detected and have
been or are being registered on the Aboriginal Heritage Register. In addition, survey of the foreshore dunes
within the plant Study Area redefined the previously-recorded Powlett River shell deposit (8020-0001) as a
much larger expanse of midden deposit extending over a distance of 385 metres, partly within the plant
Study Area. Three of the other foreshore dune midden sites originally recorded by the La Trobe University
survey were found again during the present study, and have now been recorded on the Aboriginal Heritage
Register. All sites of Aboriginal cultural heritage (whether recorded on the Heritage Register or not), are
protected under the Aboriginal Heritage Act 2006. The locations of all identified Aboriginal archaeological
sites within the plant site are shown in Figure 1.
As part of the CHMP process, many sites were amalgamated and now it is considered that seven (7)
archaeological sites exist within the plant site. A summary of these sites is presented in Table 2.

The seven Aboriginal cultural heritage sites were deemed to be in locations that were impossible to avoid in
the construction of the VDP plant and therefore these sites were salvaged by the State.
4.2. Historical (non-indigenous) Heritage sites
Prior to the current assessment, no historical archaeological sites had been recorded within the project area.

Review of relevant databases indicated that within 10 kilometres of the plant project area there are four
previously recorded historic archaeological sites listed on the Victorian Heritage Register (VHR) and an
additional 10 previously recorded sites on the Heritage Victoria Inventory (HVI). Two further previously
recorded sites are listed on Heritage Victoria’s D list. These D-listed sites are of local historical interest but
are not protected by State legislation (Heritage Act 1995). Relevant previously recorded sites are presented
in Table 3.
Within the project area there is one previously recorded site listed on the HVI, Wonthaggi Western Area
H8020-0007, which is adjacent (south east) of the site (Figure 2). This site is an extensive mining and
haulage site, located around a main shaft and marks the most westerly working of the Dudley Basin. As this
site is listed on the HVI, no impact can occur without Consent from HV.
The Bass Coast Shire heritage overlay lists 43 sites within a 10 kilometre radius of the site, none of which
are located in the project area.
Also within 10 kilometres of the site are 15 buildings and structures of historical interest listed on the
Registers of the National Trust (VIC) and National Estate.
The Kilcunda Coastline is listed on the Register of the National Estate for natural significance. This
registration is considered to be of potential cultural heritage value and extends from San Remo to Kilcunda to
the north-east of the site.
Background historical research was undertaken in combination with a field survey to detect sites of potential
historical archaeological significance within the project area. The investigation identified three sites within the
project area. Lower Powlett Road 1: H8020-0017 is a nineteenth-century enclosure and possible homestead
known from map evidence, has been added to the Heritage Inventory. No physical remains were found of
this site during the assessment. Any impact to this site must be done under Consent conditions from HV.
A further two historical sites were also identified via background research and recorded with HV (Selection
Boundary [Mouth of Powlett Road]: D8020-0015 and Mouth of Powlett Road (Former Rail Reserve): D8020-
0016) have been given D-listed status. No surface features could be identified during the assessment of
these sites. These sites are considered to have no archaeological component and therefore no Consent to
Destroy is required from HV prior to any impact. Figure 2 shows the location of these sites, and Table 3 gives
a summary.
