1. The Bases Conversion and Development Authority (BCDA), through 2018 GAeA, intends to apply the
sum of Three Billion Nine Hundred Million and 00/100 Pesos (PhP3,900,000,000.00), inclusive of

all applicable taxes and fees, under a modified payment scheme, being thre Approved Budget for the
o
Contract (ABC), for the Construction of Airport to NCC Access Road (Phase 1).

Bids received in excess of the ABC shall be automatically reejected at the opening of the financial
proposals. t

2. BCDA now invites bids for the Construction of Airport rto NCC Access Road (Phase 1) located at New
p
Clark City, Capas Tarlac. Completion of the Works is required in Five Hundred Forty (540) calendar

days. Prospective bidders must have completned a similar project with a contract amount of not less
than fifty percent (50%) of the ABC. Foer this purpose, similar contracts shall refer solely to
completed bridges projects. The description of an eligible bidder is contained in the Bidding

Documents, particularly, in Section II. Instructions to Bidders.

The winning bidder/s for the Codnstruction of New Clark City (NCC) to Subic-Clark-Tarlac Expressway
(SCTEX) Access Road Projeect is/are prohibited from participating in this bidding.
l

3. Bidding will be conduocted through open competitive bidding procedures using the non-discretionary
pass/fail criterion ars specified in the Implementing Rules and Regulations (IRR) of Republic Act 9184
t
(RA 9184), othnerwise known as the “Government Procurement Reform Act”.
o
Bidding cis restricted to Filipino citizens/sole proprietorships; and partnerships, corporations,
organnizations or joint ventures with at least seventy-five percent (75%) interest or outstanding capital
stUock belonging to citizens of the Philippines.

4. Prospective bidders must have at least a license category “AAA” and a license classification “Large B”
from the Philippine Contractors Accreditation Board (PCAB) for General Engineering. The PCAB
license must be valid and effective at the time of submission of the bid.

5. Interested bidders may obtain further information from BCDA and inspect the Bidding Documents at
the address given below from Wednesday, 25 April 2018 to Thursday, 31 May 2018 during office
hours between 8:00 AM and 5:00 PM and on Friday, 1 June 2018 from 8:00 AM to 12:00 NN.

6. A complete set of Bidding Documents may be purchased by interested Bidders from the address
below and upon payment of a nonrefundable fee in the amount of Seventy-Five Thousand Pesos
(PhP75,000.00).

It may also be downloaded from the website of BCDA (www.bcda.gov.ph) and the Philippine
Government Electronic Procurement System (PhilGEPS).

Interested Bidders who did not purchase and fully pay the Bidding Documents will not be allowed to
participate in the bidding.

7. BCDA will hold a Pre-Bid Conference on Thursday, 3 May 2018 at 8:30 AM at the BCDA

Corporate Center, 2/F Bonifacio Technology Center, Bonifacio Global City, Taguig City.

8. Bids must be delivered not later than Friday, 1 June 2018 at 12:00 NN at the BCDA Corporate

Center, 2/F Bonifacio Technology Center, 31st corner 2nd Avenue, Crescent Park West, Bonifacio
Global City, Taguig City. All bids must be accompanied by a bid security in eany of the acceptable
forms stated in ITB Clause 18.

A. General

1. Scope of Bid
1.1. The Procuring Entity named in the BDS, invites bids for the construction of Works, as
described in Section VI. Specifications.
1.2. The name, identification, and number of lots specific to this bidding are provided in the
BDS. The contracting strategy and basis of evaluation of lots is described in ITB
Clause 27.

1.3. The successful Bidder will be expected to complete the Works by the intended
l
completion date specified in SCC Clause 1.17. i

m
2. Source of Funds
e
The Procuring Entity has a budget or received funds from the Funding Source named in the

BDS, and in the amount indicated in the BDS. It intends to apply parrt of the funds received for
o
the Project, as defined in the BDS, to cover eligible payments under the Contract for the Works.

3. Corrupt, Fraudulent, Collusive, Coercive and Obstructive Practices
e
t
3.1. Unless otherwise specified in the BDS, the nProcuring Entity, as well as bidders and
contractors, shall observe the highest staindard of ethics during the procurement and
r
execution of the contract. In pursuancpe of this policy, the Funding Source:

n
(a) defines, for purposes of this provision, the terms set forth below as follows:
e
(i) "corrupt prhactice" means behavior on the part of officials in the public
or privawte sectors by which they improperly and unlawfully enrich
the mselves, others, or induce others to do so, by misusing the position
d
in which they are placed, and includes the offering, giving, receiving,
e
or soliciting of anything of value to influence the action of any such
l
l official in the procurement process or in contract execution; entering,
o
on behalf of the Procuring Entity, into any contract or transaction
r
manifestly and grossly disadvantageous to the same, whether or not
t
n
the public officer profited or will profit thereby, and similar acts as
o
provided in Republic Act 3019;
c
n (ii) "fraudulent practice" means a misrepresentation of facts in order to
U influence a procurement process or the execution of a contract to the
detriment of the Procuring Entity, and includes collusive practices
among Bidders (prior to or after Bid submission) designed to establish
bid prices at artificial, non-competitive levels and to deprive the
Procuring Entity of the benefits of free and open competition;
(iii) “collusive practices” means a scheme or arrangement between two or
more Bidders, with or without the knowledge of the Procuring Entity,
designed to establish bid prices at artificial, non-competitive levels;
and

(iv) “coercive practices” means harming or threatening to harm, directly or
indirectly, persons, or their property to influence their participation in a
procurement process, or affect the execution of a contract;
(v) “obstructive practice” is
(aa) deliberately destroying, falsifying, altering or concealing of
evidence material to an administrative proceedings or
investigation or making false statements to investigators in
order to materially impede an administrative proceedings or
d
investigation of the Procuring Entity or any foreign
e
government/foreign or international financing institution into
l
allegations of a corrupt, fraudulent, coercive ior collusive
a
practice; and/or threatening, harassing or intimidating any
m
party to prevent it from disclosing its knowledge of matters
relevant to the administrative proceedinegs or investigation or
from pursuing such proceedings or in vestigation; or
r
o
(bb) acts intended to materially impede the exercise of the

inspection and audit rightsd of the Procuring Entity or any
foreign government/foreeign or international financing
institution herein. t
n
i
(b) will reject a proposal for award rif it determines that the Bidder recommended
p
for award has engaged in corrupt or fraudulent practices in competing for the

Contract; and n
e
(c) will declare a firm ihneligible, either indefinitely or for a stated period of time, to
be awarded Contract funded by the Funding Source if it at any time
w
determines that the firm has engaged in corrupt or fraudulent practices in

competingd or, or in executing, a Contract funded by the Funding Source.
e
3.2. Further, the Procuring Entity will seek to impose the maximum civil, administrative,
l
and/or corilminal penalties available under the applicable laws on individuals and
organizations deemed to be involved in any of the practices mentioned in ITB Clause
r
3.1(ta).
n
o
3.3. Furthermore, the Funding Source and the Procuring Entity reserve the right to inspect
c
and audit records and accounts of a contractor in the bidding for and performance of a
n
contract themselves or through independent auditors as reflected in the GCC
U
Clause 34.
4. Conflict of Interest
4.1. All Bidders found to have conflicting interests shall be disqualified to participate in the
procurement at hand, without prejudice to the imposition of appropriate administrative,
civil, and criminal sanctions. A Bidder may be considered to have conflicting interests
with another Bidder in any of the events described in paragraphs (a) through (c) and a
general conflict of interest in any of the circumstances set out in paragraphs (d)
through (g) below:
(a) A Bidder has controlling shareholders in common with another Bidder;

(b) A Bidder receives or has received any direct or indirect subsidy from any other
Bidder;
(c) A Bidder has the same legal representative as that of another Bidder for
purposes of this Bid;
(d) A Bidder has a relationship, directly or through third parties, that puts them in a
position to have access to information about or influence on the bid of another
Bidder or influence the decisions of the Procuring Entity regarding this bidding
process;

(e) A Bidder submits more than one bid in this bidding process. However, this
l
does not limit the participation of subcontractors in more than one ibid;
a
m
(f) A Bidder who participated as a consultant in the preparation of the design or
technical specifications of the goods and related services that are the subject
e
of the bid; or

r
o
(g) A Bidder who lends, or temporarily seconds, its personnel to firms or

organizations which are engaged in consudlting services for the preparation
related to procurement for or implementeation of the project, if the personnel
would be involved in any capacity on thte same project.
n
4.2. In accordance with Section 47 of the IRrRi of RA 9184, all Bidding Documents shall be
accompanied by a sworn affidavit of thpe Bidder that it is not related to the Head of the
Procuring Entity (HoPE), membe rs of the Bids and Awards Committee (BAC),
n
members of the Technical Working Group (TWG), members of the BAC Secretariat,
e
the head of the Project Management Office (PMO) or the end-user unit, and the project
h
consultants, by consanguinity or affinity up to the third civil degree. On the part of the
w
Bidder, this Clause shall apply to the following persons:

d
(a) If the Bidder is an individual or a sole proprietorship, to the Bidder himself;
e
l
(b) If lthe Bidder is a partnership, to all its officers and members;
o
r
(c) tIf the Bidder is a corporation, to all its officers, directors, and controlling
n
stockholders;
o
c (d) If the Bidder is a cooperative, to all its officers, directors, and controlling
n shareholders or members; and
U
(e) If the Bidder is a joint venture (JV), the provisions of items (a), (b), (c) or (d) of
this Clause shall correspondingly apply to each of the members of the said JV,
as may be appropriate.
Relationship of the nature described above or failure to comply with this Clause will
result in the automatic disqualification of a Bidder.
5. Eligible Bidders
5.1. Unless otherwise indicated in the BDS, the following persons shall be eligible to
participate in this Bidding:
