PURPOSE OF THE AGENCY

685—1.1(263B)Mission. Theofficeofstatearchaeologist,hereafterreferredtoasOSA,wasorganized
in1959toprovideforthelocation,recovery,restorationandpreservationofarchaeologicalmaterialsfor
thestate,andcoordinatetheseactivitieswithotherstateagencies. TheOSApublishesbotheducational
andscientificreportsrelatedtothesedutiesandresponsibilities.
1.1(1) In order to meet these statutory objectives under Iowa Code section 263B.2 and Acts of
the Sixty-seventh General Assembly, Senate File 2200, sections 26 and 50, the OSA is defined as the
primarystateinteragencyserviceorganizationforarchaeologicalsurvey,evaluation,andmitigation. In
this capacity, the OSA is notified of projects that are funded or permitted by the state or that have the
potentialforadverselyaffectingarchaeologicalsites.
1.1(2) In instances where an agency lacks an archaeological program, the OSA will contact
appropriate institutions and professional archaeologists to determine their interest in participating in
a state-funded project.
1.1(3) If an organization or individual other than the OSA agrees to conduct archaeological
investigations, the OSA will establish a direct contact between the pertinent state agency and the
institution or professional archaeologist. In such projects the OSA acts primarily to coordinate
archaeologicalstudiesonstateprojectsandensuresthatsuchstudiesdeemednecessaryarecompleted.
1.1(4) The goal of utilizing the procedures in this rule, as they apply to the department of
transportation and to any other state agency, is to ensure that neither the state nor any of its legal
subdivisionsisresponsiblefortheneedlessdestructionofhistoricalobjects. Ifsuchdestructionoccurs,
or cannot be avoided, OSA will take proper reasonable action to obtain all possible information
concerningsuchmaterialspriortodestruction. However,OSAwillnotassumefinancialresponsibility
forintermediate-tolarge-scaleactionsinvolvingthesalvagingofarchaeologicalinformation.
1.1(5) OSA performs other duties such as expansion and development of professional and public
inputintotheoperationoftheofficeviacommunicationwithprofessionalorganizations,stateandfederal
agencies and private societies.
1.1(6) OSA provides assistance to local and regional groups or individuals throughout the state in
the areas of lectures, general assistance on public or private projects, curation of artifacts and offers
programs of assistance to public schools.
1.1(7) OSAmaintainsanarchaeologicalrepositoryforthestateandbearstherelatedresponsibility
of development and maintenance of an archaeological documents collection related to material in the
repository.
1.1(8) OSA may perform archaeological contract services for agencies utilizing federal, state, or
private funding.

685—1.2(263B) Divisions. OSA is divided into five divisions: General services, research, contract
services, field services and publication.
1.2(1) The state archaeologist carries the overall responsibility of OSA and for all activities
developedfromorassociatedwithOSA.Thestatearchaeologistshallbethedirectoroftheoffice.
1.2(2) Theassociatedirectorisresponsibleforadministrationoftheofficeandmaintenanceofthe
staterepositoryanddocumentscollection,hasfunctionalsupervisionoverthestaff,actsintheabsence
of the director, and contributes to production of scientific reports and articles pursuant to Iowa Code
section263B.2incoordinationwiththespecificrequestsofthedirectorandsubmissionofreportsand
articlestothedirectoraccordingtoaspecificannualtimetabledevelopedbythedirector.
1.2(3) Theresearcharchaeologisthastheresponsibility,inpart,forproducingscientificreportsand
articlespursuanttoIowaCodesection263B.2incoordinationwiththespecificrequestsofthedirector
andsubmittingreportsandarticlestothedirectoraccordingtoaspecificannualtimetabledevelopedby
the director.

1.2(4) ContractarchaeologistsworkingonOSAprojectsareconsideredtobemembersoftheOSA
staff. Theyhavetheresponsibilityformeetingthetermsofcontractsinwhichtheyareengaged. Reports
prepared for each project undertaken are subject to professional guidelines, federal statutes and the
director’s approval.

2.1(1) Petitionsrequestingthepromulgation,amendment,waiver,orrepealofaruleshallbemade
tothedirectorinwritingandincludethefollowinginformation:
a. Name,address,andtelephonenumberofpetitioner.
b. Thetextoftheruleasisandasproposed.
c. Aconcisestatementofthereasonsfortheadoption,amendment,waiver,orrepealoftherule.
d. Thestatutes,rules,orordersapplicabletothequestionpresentedinthepetition.
2.1(2) Ifawaiverissoughtpursuanttorule685—2.2(17A),inadditiontotheinformationsetforth
insubrule2.1(1),thepetitionshallalsoincludethefollowingdetails:
a. Precisescopeandrequesteddurationofthewaiver;
b. Therelevantfactsthatthepetitionerbelieveswillsupportthefourcriteriasetforthinparagraphs
2.2(3)“a” to “d”;

685—2.2(17A) Waivers.
2.2(1) Forthepurposesofthisrule,theterm“waiver”meansactionbythestatearchaeologistthat
suspendsinwholeorinparttherequirementsorprovisionsofaruleasappliedtoanidentifiedperson
onthebasisoftheparticularcircumstancesoftheperson.
2.2(2) ThestatearchaeologistmaygrantawaiverfromaruleonlyifOSAhasjurisdictionoverthe
ruleandtherequestedwaiverisconsistentwithapplicablestatutesandConstitutionalprovisionsorother
provisionsoflaw. OSAmaynotwaiverequirementscreatedorimposedbystatute,bythestateorfederal
Constitution, orbyanotherprovisionoflaw.
2.2(3) In response to a petition completed pursuant to rule 685—2.1(17A), OSA may in its sole
discretionissueanorderwaivinginwholeorinparttherequirementsofaruleifOSA,basedonclear
andconvincingevidence, findsallofthefollowing:
a. Theapplicationoftherulewouldimposeanunduehardshiponthepersonforwhomthewaiver
is requested;
b. The waiver from the requirements of the rule in the specific case would not prejudice the
substantial legal rights of any person;
c. Theprovisionsoftherulesubjecttothepetitionforawaiverarenotspecificallymandatedby
statute or another provision of law; and
d. Substantiallyequalprotectionofpublichealth,safetyandwelfarewillbeaffordedbyameans
otherthanthatprescribedintheparticularruleforwhichthewaiverisrequested.
2.2(4) OSA may require the petitioner to serve notice in a form prescribed by OSA on all persons
towhomnoticeisrequiredbyanyprovisionoflaw,aswellasallpersonswhomaybeimpactedbythe
grant or denial of the waiver sought. OSA may additionally require the petitioner to provide a written
statementtoOSAattestingthatnoticehasbeenprovided.
2.2(5) TheprovisionsofIowaCodesections17A.10to17A.18Aregardingcontestedcasehearings
shall apply to any petition for a waiver filed within a contested case and shall not otherwise apply to
agencyproceedingsforawaiver. Atahearingonapetitionforawaiver,thepetitionermayofferexhibits
and provide witnesses or testimony. The hearing may be in person, telephonic, or in any other format
chosenbyOSA.Thestatearchaeologist,orthedesigneeofthestatearchaeologist,shallpresideoverthe
hearing.

2.2(6) An order granting or denying a waiver shall be in writing and shall contain a reference to
theparticularpersonandruleorportionthereoftowhichtheorderpertains,astatementoftherelevant
facts and reasons upon which the action is based, and a description of the precise scope and duration
ofthewaiverifoneisissued. OSAmayplaceanyconditiononawaiverthatOSAfindsnecessaryand
supportable by the law.
2.2(7) Thefinaldecisiononwhetherthecircumstancesjustifythegrantingofawaivershallbemade
at the sole discretion of OSA, upon consideration of all relevant factors. OSA shall evaluate each fact
basedontheunique,individualcircumstancessetoutinthepetitionforwaiver. Theburdenofpersuasion
restswiththepetitionertodemonstratebyclearandconvincingevidencethatOSAshouldexerciseits
discretiontograntawaiverfromanOSArule.
2.2(8) All orders granting or denying a waiver petition shall be indexed, filed, and available for
publicinspectionasprovidedinIowaCodesection17A.3. Petitionsforawaiverandordersgrantingor
denyingwaiverpetitionsarepublicrecordsunderIowaCodechapter22. Somepetitionsorordersmay
contain information that OSA is authorized or required to keep confidential. Accordingly, OSA may
redactconfidentialinformationfrompetitionsororderspriortopublicinspection.
2.2(9) Semiannually,OSAshallprepareasummaryreportidentifyingtherulesforwhichawaiver
hasbeengrantedordenied,thenumberoftimesawaiverwasgrantedordeniedforeachrule,acitation
to the statutory provisions implemented by the rules, and a general summary of the reasons justifying
OSA’sactionsonwaiverrequests. Ifpracticable,thereportshalldetailtheextenttowhichthegranting
ofawaiverhasaffectedthegeneralapplicabilityoftheruleitself. Copiesofthisreportshallbeavailable
forpublicinspectionandshallbeprovidedsemiannuallytotheadministrativerulescoordinatorandthe
administrative rules review committee.
2.2(10) AwaiverissuedbyOSApursuanttothischaptermaybewithdrawn,canceled,ormodified
if,afterappropriatenoticeandhearing,OSAissuesanorderfindinganyofthefollowing:
a. Thepersonwhowasthesubjectofthewaiverorderwithheldormisrepresentedmaterialfacts
relevanttotheproprietyordesirabilityofthewaiver; or
b. Thesubstantiallyequivalentmeansforensuringthatthepublichealth,safetyandwelfarewill
beadequatelyprotectedafterissuanceofthewaiverorderhavebeendemonstratedtobeinsufficient;or
c. Thesubjectofthewaiverorderhasfailedtocomplywithallconditionscontainedintheorder.
2.2(11) Judicial review of the OSA decision to grant or deny a waiver petition may be taken in
accordance with Iowa Code chapter 17A.
ThisruleisintendedtoimplementIowaCodechapter17A.

685—3.1(17A)Providingdeclaratoryrulings.
3.1(1) Petitions for declaratory rulings are made to the director of the agency in writing. Each
petition shall describe the facts or circumstances giving rise to the request for a ruling, shall contain
thetextoracitationtothestatute,rule,statementoflaworpolicy,decisionorordertowhichthepetition
relates,andshallspecifytheactionrequested. TheOSAmayrequestadditionalinformationifneeded.
3.1(2) Within30daysaftersubmissionofapetitionthedirectorissuesinwritingadeclaratoryruling
ontheruleinquestion,exceptincaseswheretherequestisoutsideofthescopeofOSAauthority.
