5 (a) I*ROHIBITION ON TREATMENT AS OVERPAY-
6 MENT.—Section1903(d)(3)oftheSocialSecurityAct(42
7 U.S.C.1396b(d)(3))isamended—
8 (1)byinserting"(A)"before"The"; and
9 (2)byaddingattheendthefollowing:
10 "(B) Subparagraph (A) and paragraph (2)(B) shall
11 notapplyto anyamountrecoveredorpaidto a State as
12 partofasettlementorjudgmentreachedinlitigationiniti-
13 atedorpursuedbyaStateagainstoneormoremanufac-
14 turers oftobaccoproducts, as definedin section 5702(d)
15 oftheInternalRevenueCodeof1986.".

16 (b) Effective Date. The amendment made by
17 subsection (a) apphes to amounts recoveredorpaidto a
18 State before, on, or after the date ofenactment ofthis
19 Act.
