7 "SEC.2689.AUTHORITYFORTHESECRETARYOFHEALTH
8 ANDHUMANSERVICESTOADMINISTERCER-
9 TAINGRANTS.
10 "(a) In General.—With respect to a grant made
11 to an ehgible area or a State underpartAor B ofthis
12 title, ifthe Secretarydetermines, after reasonable notice
13 andopportunityforhearing,thattheehgibleareaorState
14 has substantially failed to make appropriate use of any
15 grantmadeunderpartAorB ofthistitleduringeither
16 ofthetwopreviousfiscalyears,thegrantshallbeadminis-
17 teredbythe Secretaryinheu ofthe chiefelectedofficial
18 of such ehgible area or State, but in all other respects
19 in accordancewith the grantrequirements underpartA
20 orBofsuchtitle.
21 "(b) Prohibition on Administration for Con-
22 SECUTIVE Years.—In any case m which a grant made
23 to an ehgible area or a State has been administered by
24 theSecretarypursuanttosubsection(a),theSecretaryis
25 not authorizedto administer anygrant made duringthe

2 suanttosubsection(a).

3 "(c)Determination. Inmakingthedetermination
4 undersubsection (a), the Secretaryshall considerwheth-
5 er
6 "(1) more than 5 percent of the grant funds
7 awarded remamed unobUgated one year after the
8 dateonwhichthegrantwasmade;
9 "(2) the ehgible area or State has had addi-
10 tionalrequirementsimposedonthegrantundersec-
11 tion74.14(a) oftitle45oftheCodeofFederalReg-
12 ulations (as in effect on the date ofthe enactment
13 ofthissection);or
14 "(3) the ehgible area or State has had special
15 conditions or restrictions imposed on the grant
16 under section 92.12(a) of title 45 of the Code of
17 Federal Regulations (as in effect onthe date ofthe
18 enactmentofthissection).

19 "(d) Delegation. Withrespectto agrantadmin-
20 isteredbytheSecretaryinheuofthechiefelectedofficial
21 undersubsection(a),theSecretarymaydelegatetoaFed-
22 eralinstrumentahtyorprivateentitytheauthoritytoad-
23 ministersuchgrant.".
