5 (a) In General. Forpurposes ofsection 1837 of
6 the Social Security Act, the Secretary of Health and
7 HumanServicesshallestablishanopenenrollmentperiod
8 forthefirst4monthsof1995duringwhichanindividual
9 described in section 2 may enroll in the supplementary
10 medical insurance program established under part B of
11 titleXVIIIofsuchAct.
12 (b) War^r of Penalty for Late Enroll-
13 MENT.—Forpurposesofsection 1839(b)oftheSocialSe-
14 curityAct,anindividualdescribedinsection2whoenrolls
15 inpartBofthemedicareprogramduringtheopenenroU-
16 mentperioddescribedinsubsection(a)shallbeconsidered
17 to have enrolled in part B of such program during the
18 individual's initial enrollment period under section 1837
19 ofsuchAct.
20 SEC.2.INDIVIDUALSELIGIBLETOENROLLDESCRIBED.
21 Anindividualdescribedinthissectionisanindividual
22 whowouldbedescribed in section 1086(d)(2) oftitle 10,
23 UnitedStatesCode, iftheindividualwereenrolledinthe
24 supplementarymedical insurance program under part B
25 oftitleXVIIIoftheSocialSecurityAct.
