NOTICE OF NONDISCRIMINATION RIGHTS AND PROTECTIONS
The Boston Region Metropolitan Planning Organization (MPO) operates its programs, services, and
activities in compliance with federal nondiscrimination laws including Title VI of the Civil Rights
Act of 1964 (Title VI), the Civil Rights Restoration Act of 1987, and related statutes and regulations.
Title VI prohibits discrimination in federally assisted programs and requires that no person in the
United States of America shall, on the grounds of race, color, or national origin (including limited
English proficiency), be excluded from participation in, denied the benefits of, or be otherwise
subjected to discrimination under any program or activity that receives federal assistance. Related
federal nondiscrimination laws administered by the Federal Highway Administration, Federal Transit
Administration, or both, prohibit discrimination on the basis of age, sex, and disability. The Boston
Region MPO considers these protected populations in its Title VI Programs, consistent with federal
interpretation and administration. In addition, the Boston Region MPO provides meaningful access
to its programs, services, and activities to individuals with limited English proficiency, in compliance
with U.S. Department of Transportation policy and guidance on federal Executive Order 13166.
The Boston Region MPO also complies with the Massachusetts Public Accommodation Law, M.G.L.
c 272 section 92a, 98, 98a, which prohibits making any distinction, discrimination, or restriction
in admission to, or treatment in a place of public accommodation based on race, color, religious
creed, national origin, sex, sexual orientation, disability, or ancestry. Likewise, the Boston Region
MPO complies with the Governor’s Executive Order 526, section 4, which requires that all programs,
activities, and services provided, performed, licensed, chartered, funded, regulated, or contracted for
by the state shall be conducted without unlawful discrimination based on race, color, age, gender,
ethnicity, sexual orientation, gender identity or expression, religion, creed, ancestry, national origin,
disability, veteran’s status (including Vietnam-era veterans), or background.

Certification of the Boston Region MPO Transportation Planning Process
The Boston Region Metropolitan Planning Organization certifies that its conduct of the metropolitan
transportation planning process complies with all applicable requirements, which are listed below, and that this
process includes activities to support the development and implementation of the Regional Long-Range
Transportation Plan and Air Quality Conformity Determination, the Transportation Improvement Program and
Air Quality Conformity Determination, and the Unified Planning Work Program.
1. 23 USC 134, 49 USC 5303, and this subpart.
2. In nonattainment and maintenance areas, sections 174 and 176 (c) and (d) of the Clean Air Act, as
amended (42 USC 7504, 7506 (c) and (d) and 40 CFR Part 93.
3. Title VI of the Civil Rights Act of 1964, as amended (42 USC 2000d-1) and 49 CFR Part 21.
4. 49 USC 5332, prohibiting discrimination on the basis of race, color, creed, national origin, sex, or
age in employment or business opportunity.
5. Section 1101(b) of the Fast Act (Pub. L. 114-357) and 49 CFR Part 26 regarding the involvement of
disadvantaged business enterprises in U.S. DOT-funded projects.
6. 23 CFR part 230, regarding implementation of an equal employment opportunity program on
Federal and Federal-aid highway construction contracts;
7. The provisions of the Americans with Disabilities Act of 1990 (42 USC 12101 et seq.) and 49 CFR
Parts 27, 37, and 38.
8. The Older Americans Act, as amended (42 USC 6101), prohibiting discrimination on the basis of
age in programs or activities receiving federal financial assistance.
9. Section 324 of Title 23 USC regarding the prohibition of discrimination based on gender.
10. Section 504 of the Rehabilitation Act of 1973 (29 USC 794) and 49 CFR Part 27 regarding
discrimination against individuals with disabilities.
11. Anti-lobbying restrictions found in 49 USC Part 20. No appropriated funds may be expended by a
recipient to influence or attempt to influence an officer or employee of any agency, or a member of
Congress, in connection with the awarding of any federal contract.
