END USER LICENSE AGREEMENT
This End User License Agreement (the “Agreement”) constitutes a binding contract between you – a
legal person (a company, a partnership or any other legal entity (hereinafter, an “Organization”) or an
individual whether acting for or on behalf of an organization (hereinafter, an “Organizational User”)
or otherwise (hereinafter, an “Independent User”), on the one hand, and CYMMETRIA®, INC.,
(“We”, “Us”, “Our”, the “Company”, “Cymmetria”) on the other hand, and governs your use of
Cymmetria's product(s) and services. For the avoidance of doubt, the terms “You” and “Your” will
apply collectively to such organization, organizational user and independent user.
If you are an organizational user, you are hereby entering into an agreement personally as well as for
and on behalf of the organization, and you therefore represent and warrant that you are duly authorized
and empowered to enter into this agreement for and on behalf of the organization.
Taking any step to set-up, configure or install the software constitutes your acceptance of this
agreement. If you do not agree to all of the terms and conditions set forth herein, do not access and/or
use any part of the software.
You may not accept this agreement and/or use the software if you are not qualified to create a binding
legal agreement, or if the use of the software is prohibited by the law applicable to you.

1. THE PRODUCT
This Agreement pertains to Cymmetria’s software product known as MazeRunner 1.5 Community
Edition, together with any updates or documentation provided to You or made available by
Cymmetria in respect thereof (collectively, the “Product” or the “Software”). This will also
include any subsequent or modified versions of the Product that Cymmetria may, at its sole
discretion, choose to make available. The Product is subject to modification from time to time at
Cymmetria’s sole and absolute discretion.

2. THE LICENSE
Organization and Organizational User License: Subject to Your compliance with all of terms of this
Agreement, Cymmetria hereby grants You a non-exclusive, non-sublicensable, non-transferable,
limited, revocable license to use the Software, in accordance with the provided documentation,
solely for Your internal testing and evaluation of the Software and its performance in a non-
production environment. The license granted to You is not limited to any number of "decoys" and
"endpoints" in the first 30 days, and is thereafter limited to 1 decoy and 10 endpoints. Subsequent
modifications or updates to the Software do not extend this period.

Independent User License: Subject to Your compliance with all of terms of this Agreement,
Cymmetria hereby grants You a non-exclusive, nonsublicensable, nontransferable, limited,
revocable license to use the Software, in accordance with the provided documentation, solely for
private, noncommercial use, in a non-production environment.

Academic Use License: For inquiries regarding the use of MazeRunner and other Cymmetria
products in an academic setting, including deployment on an academic network or as a tool in
academic research, please contact us at [email protected]. Please provide a description of
your planned use – if possible, please provide details regarding the type, extent, duration and
purpose of the planned use. We welcome collaboration with the academic community and are more
than happy to discuss specific licensing options upon request.
Except as expressly provided in this Agreement, no other rights or licenses, expressed or implied,
are granted to You (whether You are an Organization, Organizational User or an Independent User),
and all rights are expressly reserved by Cymmetria.

3. UPDATES AND VALIDATION
The Software may periodically check Cymmetria's servers for information on available updates of
the Software. For this purpose, the Software may transmit to Cymmetria information regarding your
Software version, Deployment type, and other information (the use of such information shall be in
accordance with our privacy policy (available at
https://www.cymmetria.com/legal/1.5.0/eula/privacy-policy)).
You may obtain updates for the Software only from Cymmetria or an authorized third party. At
Cymmetria's full discretion, some updates may be automatically installed in your system, and by
accepting this agreement, you agree to receive these types of automatic updates without any
additional notice.

4. OWNERSHIP, FEEDBACK
You acknowledge that Cymmetria retains all right, title, and interest in and to the Software
(including all intellectual property rights therein and data generated through Company’s use of the
Software). You further acknowledge that this Agreement does not convey to You any interest in
or to the Software, except for a limited right of use as set forth herein, terminable in accordance
with this Agreement. Any suggestions, ideas, enhancement requests, feedback, recommendations
or other information provided by You relating to the Software are hereby assigned to Cymmetria
(including all intellectual property rights in the foregoing, as well as any ideas, modifications,
suggestions, improvements, and the like made as a result thereof). You will not copy, distribute,
reproduce or use any of the foregoing except as expressly permitted under this Agreement.

5. RESTRICTIONS ON USE
You will not, and will not permit any third party to: reverse engineer, decompile, disassemble or
otherwise attempt to discover the source code, object code or underlying structure, ideas or
algorithms of the Software (provided that reverse engineering is prohibited only to the extent such
prohibition is not contrary to applicable law); modify, translate, or create derivative works based
on the Software; use the Software for timesharing or service bureau purposes or for any purpose
other than Your own internal use, or allow any third party to access any part of the Software;
redistribute or sublicense any part of the Software; modify or alter any trademarks, service marks,
logos, insignia or any other designation, whether registered or not; use the Software for the benefit
of a third party; or use the Software other than in accordance with this Agreement and in
compliance with all applicable laws and regulations.

6. TERMINATION
Cymmetria may terminate or suspend Your license immediately, without prior notice or liability,
if You breach, or fail to comply with, any of the provisions contained in this Agreement.
Cymmetria may at any time, with or without cause, terminate this Agreement by reasonable notice
to You.
In the event that You are an Organization or an Organizational User, then this Agreement will
automatically terminate upon the expiration of the Organizational Term detailed above.
Upon the termination of this Agreement for any reason, your license hereunder will terminate and
You will (i) cease all use of the Software, and (ii) properly destroy or return to Cymmetria the
Software, the Documentation and all copies thereof (including any copies that may have been

created by your automatic backup systems). All the provisions of this Agreement which by their
nature should survive termination (including, without limitation, ownership provisions, warranty
disclaimers, indemnification obligations and limitations of liability) shall remain in full force and
effect following termination thereof. Termination of this Agreement shall not relieve You from
any obligation arising or accruing prior to such termination or limit any liability which you
otherwise may have to Cymmetria.

7. THIRD PARTY SOFTWARE
The Product(s) may contain software or other materials provided by third parties (including "open
source" software) ("Third Party Materials"). The license terms, copyright notices and available
source code with respect to Third Party Materials can be found in the Appendix to this Agreement.
Use of such Third Party Materials shall be governed by the license agreements specific to each
such Third Party Material, provided, however, that in addition to any terms and conditions of any
third party software license as set forth in the abovementioned webpage, and without derogating
from such terms, the disclaimer of warranty and limitation of liability set forth herein shall apply
to all software. If the Software contains any software provided by third parties not noted in the
abovementioned webpage, the restrictions contained in this Agreement shall apply to all such third
party software providers and third party software as if they were Cymmetria and the Software,
respectively. By using the Software you agree to the licenses that apply to any Third Party
Materials.

Prior to installing any part of the Software, you may be required to install additional third party
software, if such third party software is not already installed on your hardware or devices. This
third party software is separate and independent of the Software. The use of such software is not
governed by this Agreement, and shall be governed only by the license agreements specific to
such software, to which Cymmetria is not a party. No legal relationship shall be formed between
Cymmetria and You with respect to such third party software. IN NO EVENT SHALL
CYMMETRIA BE LIABLE FOR ANY DAMAGE CAUSED BY SUCH SEPARATE AND
INDEPENDENT THIRD PARTY SOFTWARE. SUCH SOFTWARE IS PROVIDED "AS IS",
WITHOUT ANY WARRANTY BY CYMMETRIA. YOU ARE SOLELY RESPONSIBLE TO
OBTAIN THE REQUIRED THIRD PARTY SOFTWARE PRIOR TO THE INSTALLATION
OF THE SOFTWARE, AND FOR COMPLIANCE WITH THE REQUIRED THIRD PARTY
SOFTWARE LICENSE AGREEMENTS. YOU SHALL HAVE NO CLAIM AGAINST
CYMMETRIA, AND ITS AFFILIATED ENTITIES, AND THEIR EMPLOYEES,
CONTRACTORS, OFFICERS, DIRECTORS, AGENTS AND REPRESENTATIVES, THAT
ARISES DIRECTLY OR INDIRECTLY FROM YOUR FAILURE TO ACQUIRE SUCH
LICENSES (INCLUDING BUT NOT LIMITED TO CLAIMS OF UNLICENSED USE,
BREACH OF CONTRACT OR COPYRIGHT INFRINGEMENT).

8. WARRANTY DISCLAIMER
WARRANTY DISCLAIMER. TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, CYMMETRIA MAKES NO WARRANTIES OF ANY KIND, AND
ANYTHING PROVIDED BY OR ON BEHALF OF CYMMETRIA UNDER THIS
AGREEMENT IS PROVIDED “AS IS, AS AVAILABLE” AND WITHOUT WARRANTY OF
ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES
OF PERFORMANCE OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR
PURPOSE OR NON-INFRINGEMENT, ALL OF WHICH ARE HEREBY DISCLAIMED BY
CYMMETRIA, ON BEHALF OF ITSELF AND ITS LICENSORS. NOTWITHSTANDING

ANYTHING TO THE CONTRARY HEREIN, CYMMETRIA DOES NOT WARRANT THAT
THE SOFTWARE OR ANY SERVICES RELATED THERETO WILL BE ERROR-FREE OR
WITHOUT INTERRUPTION, OR THAT THE SOFTWARE WILL ACHIEVE THE RESULTS
DESIRED BY YOU.

9. SPECIAL PROVISIONS FOR THE PROTECTION OF PRIVACY AND DATA
PLACED IN THE DECOY COMPONENT OF THE SOFTWARE.
The Software contains components that are intended to lure and attract the attention of potentially
malicious actors (primarily, the Decoys and Breadcrumbs) ("Components"). Cymmetria may
require full access to the information placed in these Components, in order to ensure the proper
functioning of the Software and to ensure it fulfils its intended purposes.
SINCE WE ALLOW YOU TO DECIDE WHICH INFORMATION TO INCLUDE IN THE COMPONENTS, WE
ASSUME THAT ANY INFORMATION YOU INCLUDE IS NOT OF A PRIVATE, SENSITIVE OR OTHERWISE
PROTECTED NATURE. YOU EXPRESSLY ACKNOWLEDGE THAT ANY INFORMATION YOU STORE IN
THE COMPONENTS IS LIKELY TO BE ACCESSED BY UNAUTHORIZED PARTIES.
YOU THEREFORE EXPLICITLY ACKNOWLEDGE THAT YOU BEAR THE SOLE
RESPONSIBILITY TO ENSURE THAT THE COMPONENT IS LOADED STRICTLY WITH
INFORMATION THAT YOU ARE ENTITLED AND AUTHORIZED TO SHARE AND
DISCLOSE TO UNKNOWN THIRD PARTIES.
YOU HEREBY WARRANT AND UNDERTAKE NOT TO LOAD THE DECOY OR ANY
OTHER PART OF THE SOFTWARE WHICH YOU CONTROL WITH INFORMATION
THAT IS OF A PRIVATE, SENSITIVE OR OTHERWISE PROTECTED NATURE
ACCORDING TO THE LAW APPLICABLE TO YOU, OR WHICH YOU WOULD LIKE TO
PROTECT FROM UNAUTHORISED USE OR DISCLOSURE.

You explicitly and expressly waive any claims against Cymmetria arising from the unauthorised
access of any party to the information you place in the Components. You further agree to
indemnify, defend and hold harmless Cymmetria and its affiliated entities, and their employees,
contractors, officers, directors, agents and representatives, from any liability, claim or demand,
including reasonable attorneys' fees, arising out of or related to the information included in the
Components and the access and use of such information.

If we detect a breach in the security of your Components or detect a violation of the privacy of
information that You placed in a Component designed to attract the attention of a potentially
malicious actor, Cymmetria shall notify You of the breach, and you alone shall assume all
responsibility for complying with the relevant legal requirements of breach notification to all
persons and entities involved (including, without limitation, all third parties) and bear all liability
for failure to comply with said requirements. You further agree to indemnify, defend and hold
harmless Cymmetria and its affiliated entities, and their employees, contractors, officers, directors,
agents and representatives, from any liability (including, without limitation, any civil or criminal
liability), claim or demand, including reasonable attorneys' fees, arising out of or related to failure
to comply with such requirements. For the avoidance of doubt, it is hereby stated that such
notification may come in the form of an alert generated by the Software.

Should you elect to provide Cymmetria with additional data for the purpose of improving the
Software, you hereby authorize Cymmetria to access, copy, store, view and analyze any and all
information you place in the Components. You explicitly acknowledge awareness that
Cymmetria's access may include but not be limited to samples of code that is executed on the
Component and access to the automated logs, memory dumps or other means of preservation of
information installed in the Component. If Cymmetria decides, at its sole discretion, to store such

information at our servers (or servers under our direct control), we shall employ reasonable
commercial efforts to anonymize the information collected for the purposes of improving the
Software.

If you wish to access and/or request us to make corrections to Personal Information that may be
stored with Cymmetria, or wish to request a list of what Personal Information (if any) pertaining
to you we disclosed to third parties in accordance with the California Civil Code Section 1798.83
(as applicable), feel free to send us an e-mail to [email protected] or mail your request to
Cymmetria at 91 Hahashmonaim Street, Tel Aviv Jaffa, 6713308 c/o Privacy Compliance Officer,
Legal Department , and we will respond within a reasonable timeframe and in accordance with
any applicable law.

10. INDEMNIFICATION
You will indemnify, defend, and hold Cymmetria and its shareholders, directors, officers,
employees, affiliates, licensors and suppliers harmless from and against any and all claims,
liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees)
arising from or related to any third party claims directly arising from (a) use of the Software by
You (including persons obtaining access to the Software from you); (b) a violation by You of this
Agreement; (c) a violation of the specific provisions regarding the protection of privacy and data
as stated in Section 9 above.

11. LIMITATION OF LIABILITY:
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, IN NO EVENT WILL
CYMMETRIA (OR ANY OF ITS SHAREHOLDERS, DIRECTORS, OFFICERS,
EMPLOYEES, AGENTS, AFFILIATES, LICENSORS OR SUPPLIERS) BE LIABLE IN
CONNECTION WITH THIS AGREEMENT FOR (A) ANY INDIRECT, PUNITIVE,
INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR COST OF
PROCUREMENT OF SUBSTITUTE GOODS, SOFTWARE OR TECHNOLOGY, (B)
DAMAGES ARISING FROM LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST
BUSINESS OR LOST SALES, ALL EVEN IF CYMMETRIA IS ADVISED OF THE SAME.
WITHOUT DEROGATING FROM THE FOREGOING, THE AGGREGATE LIABILITY OF
CYMMETRIA (AND ANY OF ITS SHAREHOLDERS, DIRECTORS, OFFICERS,
EMPLOYEES, AGENTS, AFFILIATES, LICENSORS OR SUPPLIERS) WILL NOT EXCEED
ONE U.S. DOLLAR (US$1.00).
WITHOUT DEROGATING FROM THE FOREGOING, CYMMETRIA SHALL BEAR NO
LIABILITY OR RESPONSIBILITY FOR ANY ACTS OR OMISSIONS PERFORMED BY
YOU (OR THE CONSEQUENCES THEREOF) IN RESPONSE TO EVENTS AND/OR
ALERTS GENERATED BY THE SOFTWARE; AND YOU CONFIRM THAT YOU ASSUME
SOLE AND EXCLUSIVE RESPONSIBILITY (I) FOR ALL SUCH ACTS OR OMISSIONS
AND THE CONSEQUENCES THEREOF; AND (II) FOR THOROUGHLY AND
FREQUENTLY CHECKING FOR AND REVIEWING ANY EVENTS AND/OR ALERTS
GENERATED BY THE SOFTWARE.
THE FOREGOING LIMITATIONS WILL APPLY NOTWITHSTANDING ANY FAILURE OF
ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

12. PRIVACY POLICY
We take the protection of Your information seriously. Please carefully review our Privacy Policy,
available at https://www.cymmetria.com/legal/1.5.0/eula/privacy-policy which explains how we
collect information and how we use it. Our Privacy Policy is hereby incorporated into this
Agreement by reference and forms an integral part hereof.

13. GENERAL
13.1. U.S. Government Matters. Notwithstanding anything else, You may not provide to any
person or export or re-export or allow the export or re-export of the Software or anything
related thereto or any direct product thereof (collectively “Controlled Subject Matter”),
in violation of any restrictions, laws or regulations of the United States Department of
Commerce, the United States Department of Treasury Office of Foreign Assets Control,
or any other United States or foreign agency or authority. Without limiting the foregoing
You acknowledge and agree that the Controlled Subject Matter will not be used or
transferred or otherwise exported or re-exported to countries as to which the United States
maintains an embargo (collectively, “Embargoed Countries”), or to or by a national or
resident thereof, or any person or entity on the U.S. Department of Treasury’s List of
Specially Designated Nationals or the U.S. Department of Commerce’s Table of Denial
Orders (collectively, “Designated Nationals”). The lists of Embargoed Countries and
Designated Nationals are subject to change without notice. Use of the Software is
representation and warranty that the user is not located in, under the control of, or a national
or resident of an Embargoed Country or Designated National. The Controlled Subject
Matter may use or include encryption technology that is subject to licensing requirements
under the U.S. Export Administration Regulations. As defined in FAR section 2.101, any
software and documentation provided by Cymmetria are “commercial items” and
according to DFAR section 252.227 7014(a)(1) and (5) are deemed to be “commercial
computer software” and “commercial computer software documentation.” Consistent with
DFAR section 227.7202 and FAR section 12.212, any use modification, reproduction,
release, performance, display, or disclosure of such commercial software or commercial
software documentation by the U.S. Government will be governed solely by the terms of
this Agreement and will be prohibited except to the extent expressly permitted by the terms
of this Agreement.
13.2. Amendments. Cymmetria may change this Agreement from time to time, without notice
to You reasonable time in advance. The revised terms shall become effective unless You
then notify Cymmetria of Your objection to them. You agree that Your continued use of
the Software shall constitute Your consent to the new or revised terms. Your objection to

revision of the terms may result in Us terminating this Agreement in accordance with the
provisions of Section 6 (termination) above.
13.3. Assignment. Cymmetria may at any time assign any of its rights and/or obligations
hereunder to any third part without Your consent.
13.4. Governing Law. This Agreement will be governed by and construed in accordance with
the laws of the state of California without reference to its conflict of laws provisions.
13.5. Severability. In the event that any of the provisions of this Agreement are held by to be
unenforceable by a court or arbitrator, the remaining portions of the Agreement will remain
in full force and effect.
13.6. No Waiver. The failure of Cymmetria to enforce any right or provision in this Agreement
will not constitute a waiver of such right or provision unless otherwise acknowledged and
agreed by Cymmetria in writing.
13.7. Entire Agreement. This Agreement is the complete and exclusive agreement between You
and Cymmetria with respect to the subject matter hereof, superseding any prior agreements
and communications (both written and oral) regarding such subject matter. This
Agreement will also govern any future upgrades or updates or new releases provided by
Cymmetria in connection with the Product, unless any such upgrades or updates are
accompanied by a separate license, in which case the terms of that separate license will
govern.
